ITEM #1 <br />CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF OCTOBER 17, 2006 <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />FROM: Community Development Department & City Attorney <br />SUBJECT: APPROVAL OF EXTENSION OF URGENCY <br />ORDINANCE NO. 0-17-06 (WEST VALLEY <br />MORATORIUM) FOR A PERIOD OF TEN (10) MONTHS <br />AND FIFTEEN (15) DAYS ON THE APPROVAL OF LAND <br />USE ENTITLEMENTS AND PERMITS WITHIN AN <br />AREA NORTH OF I-10, SOUTH OF SAN BERNARDINO <br />AVENUE, AND WEST OF HERMOSA AVENUE TO THE <br />WESTERLY CITY LIMIT. <br />DATE: October 10, 2006 <br />BACKGROUND: <br />On September 19, 2006, the City Council adopted Urgency Ordinance No. 0-17-06 prohibiting <br />the approval of land use entitlements and permits on property in the West Valley area of the <br />City ("West Valley Moratorium"). The boundaries of the West Valley Moratorium generally <br />include an area north of the Interstate 10 Freeway, south of San Bernardino Avenue and west of <br />Hermosa Avenue to the westerly City limits. (See Exhibit A of attached urgency ordinance) The <br />West Valley moratorium was approved by 4/5ths vote of the City Council because of concerns <br />that some land use could be approved that would be incompatible with the recommendations <br />from the EDSPAC (Economic Development Strategic Planning Advisory Committee) and the <br />City's expressed land use vision for the West Valley area. Such land uses would also be <br />incompatible with the contemplated General Plan and zoning revisions being considered, <br />including changes in land use designations and General Plan goals and policies that attempt to <br />mitigate the impacts of intense land uses on surrounding properties. <br />Since the adoption of the 45 -day West Valley Moratorium on September 19, 2006, City staff have: <br />1) Completed a draft of the CBMP and submitted it to USFWS for preliminary review. The <br />CMBP proposes habitat conservation in the West Valley area and minimized the amount of <br />
