Recitals 2.1 City is a municipal corporation organized under the laws of the State of California, with power to contract for services necessary to achieve its purpose. 2.2 Contractor is a professional contractor, experienced in providing Pour in Place Safety Surfacing services and is familiar with the plans of the City. 2.3 City desires to engage Contractor for the installation of Safety Surface as set forth herein. 2.4 Contractor has obtained, and delivers concurrently herewith, INSURANCE DOCUMENTS as required by the Contract. 3. Terms 3.1 Incorporation of Documents. This Contract includes and hereby incorporates in full by reference the following documents, including all exhibits, drawings, specifications and documents therein, and attachments and addenda thereto: Safeguard Surfacing of California Cost Proposal #06-3-1745-01 Rev Dated October 19, 2006. 3.2 Contractor's Basic Obligation,• Scope of Work. Contractor promises and agrees to be responsible for all labor, materials, tools, equipment, and applicable taxes to perform all work and services for the installation of the surface. The surface shall be stable and lip resistant to comply with all requirements set forth in the Americans with Disabilities Act. Including all structures and facilities necessary for the installation of safety surfacing Davis Park Project or described in the Contract (hereinafter the "Work" or "Project"), for a Total Contract Price as specified pursuant to this 1 (BB&K: revised July 2, 2001)
