(FILE INDEX NO. DAP24-0037) <br />WHEREAS, the Planning Commission of the City of Colton ("Planning Commission") <br />held a public hearing on June 24, 2025, after giving published notice to consider a recommendation <br />to the City Council of a Zoning Map Amendment to Title 18 (Zoning) of the Colton Municipal <br />Code recommending approval of Change of Zone adding Residential Overlay (R-O) Zone on <br />property located at 100 North 2°a Street (APN: 0162-124-17); and <br />WHEREAS, all other legal prerequisites to the adoption of this Resolution have occurred. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF COLTON DOES ORDAIN AS FOLLOWS: <br />SECTION 1. The City Council hereby adopts the recitals and findings with respect to the <br />Ordinance for the Zoning Map Amendment, as set forth in the attached Exhibit "A" as it is fully <br />set forth herein. <br />SECTION 2. Pursuant to section 18.58.050 F. of Title 18 (Zoning Code), in considering <br />any request for a change of zone, the City Council shall review if the following conditions prevail <br />before the proposed Residential Overlay zone change be granted: <br />1. That the proposed change of zone is in conformity with the General Plan of the City, <br />in that the proposed changes are consistent with the existing provisions of the Colton <br />Zoning Code and are in the public interest since they more closely conform zoning <br />regulations with development goals and the City's General Plan. <br />2. That there is a need in the communityfor more of the types of Uses Permitted by the <br />zone, in that the proposed changes would allow a 23 unit an acre residential <br />condominium project in compliance with Development Standards of Title 18 (Zoning <br />Code) of the City's Municipal Code. The proposed project under the same case number <br />also provides a sixteen unit condominium project that complies with Title 18 of the <br />City's Municipal Code as conditioned in Planning Commission Resolution No. R-14-25. <br />That the proposed change of zone would not adversely affect the surrounding area or <br />the community in general, in that the proposed Residential Overlay (R-O) Zone is <br />consistent with surrounding residential neighborhood that includes home with one to two <br />story structures. The scale and design of the sixteen unit condominium project provides <br />private and common open space that complies with City Code. All off street parking and <br />setback requirements are in compliance with Title 18 (Zoning Code). <br />SECTION 3. The City Council hereby adopt the Ordinance, in substantially the form <br />attached hereto as Exhibit "A," as amended, which is incorporated by reference. <br />
