PARTIES AND DATE <br />This Second Amendment to the Professional Services Agreement ("Second Amendment") <br />dated as of the 4th day of April, 2007 is entered into by and between the City of Colton ("City") and <br />CCC Consultants, a Corporation with its principal place of business at 22431 Antonio Pkwy B 160- <br />254, Rancho Santa Margarita, CA 92688 ("Consultant") <br />ARTICLE 2. RECITALS <br />2.1 City and Consultant entered into that certain Professional Services Agreement dated <br />September 19, 2006, whereby Consultant agreed to provide Plan Check Consulting <br />Services/("Agreement"). <br />2.2 City and Consultant amended the Agreement in December of 2006 to increase the <br />compensation by $25,000.00. <br />2.3 City and Consultant now desire to amend the Agreement a second time to increase the <br />amount of compensation by an additional $50,000.00 for a total compensation amount of <br />$150,000.00. <br />ARTICLE 3. TERMS <br />3.1 Section 3.3.1 of the Agreement is hereby deleted in its entirety and replaced with a <br />new Section 3.3.1 to read as follows: <br />3.3.1 Compensation. Consultant shall receive compensation, including authorized <br />reimbursements, for all Services rendered under this Agreement at the rates set forth <br />in Exhibit "C" attached hereto and incorporated herein by reference. The total <br />compensation shall not exceed One Hundred and Fifty Thousand Dollars <br />(5150,000.00) without written approval of the City's Representative. Extra work <br />may be authorized, as described below, and if authorized, will be compensated at the <br />rates and manner set forth in this Agreement. <br />RVPUB\NGS\635122 -1- <br />
