ITEM #19 <br />CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF JULY 17, 2007 <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />FROM: AMER JAKHER, P.E.; PW DIRECTOR/ CITY ENGINEER <br />SUBJECT: APPROVE AWARD OF MAINTENANCE AGREEMENT TO <br />EZ SUNNYDAY LANDSCAPE FOR LLMD MAINTENANCE SERVICES <br />IN THE ANNUAL AMOUNT OF $ 242,968.10. <br />DATE: JULY 10, 2007 <br />BACKGROUND: <br />In May 2005, the city advertised its intent to contract out landscaping services for the Landscape <br />and Lighting Maintenance District 1 and 2; these services were formally bid as required by Section <br />3.08.060(c) of the city's Purchasing Ordinance. The lowest responsible and responsive bidder <br />was EZ Sunnyday Landscape. An agreement was awarded by Council action on September 6, <br />2005 for EZ Sunnyday Landscape to provide these services. The terms of this agreement allow <br />Council to award the landscape maintenance services to EZ Sunnyday Landscape for up to five <br />renewable terms; the awarded agreement defines a term as a single year. For each term which <br />the agreement is extended the contractor is compensated for any increases noted by the local <br />counties' January consumer price index (CPI). The original bid was awarded for the amount of <br />$196,800. New areas added to the LLMDs during fiscal year 2006/2007 plus the January 2006 <br />CPI index of 5.4%, increased the compensation for the first extension of the agreement's term to <br />$216,597. <br />DISCUSSION/ANALYSIS: <br />EZ Sunnyday Landscape has continued to provide satisfactory landscape maintenance services <br />for the LLMDs and staff requests extending the agreement for a third term to begin July 2007 and <br />end June 2008. The noted January 2007 CPI index was 3.2%, thus the LLMD landscape <br />maintenance services compensation rate will increase to $223,528.10, for fiscal year 2007/2008. <br />Additional areas not maintained by the Public Works Department which also have a need for <br />landscape maintenance include: Colton Palms (until demolished), all city Fire Stations and the <br />Police Tow Yard. Per Section 3.08.060 of the city's Purchasing Ordinance an existing <br />maintenance agreement can be amended by Council action to include additional work. The <br />amended scope of work will increase compensation of the agreement for fiscal year 2007/2008 in <br />the amount of $19,440; of this amount $10,800 will provide for landscape maintenance of Colton <br />Palms, $5,040 for the city's four Fire Stations, and $3,600 for the Police Tow Yard. The total <br />compensation in the proposed fiscal year 2007/2008 agreement will not exceed $242,968.10. <br />7/10/03 City Clerk's Office Cb <br />
