ITEM #17 <br />CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF September 4, 2007 <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />FROM: JEANNETTE OLKO, ELECTRIC UTILITY DIRECTOR <br />SUBJECT: ADOPT A RESOLUTION TO SUMMARILY VACATE TWO (2) <br />ELECTRIC UTILITY TRANSMISSION RIGHT OF WAY PUBLIC <br />SERVICE EASEMENTS, PURSUANT TO STREETS AND HIGHWAYS <br />CODE SECTION 8330 ET SEQ., AND AUTHORIZE THE CITY <br />MANAGER TO EXECUTE THE NECESSARY DOCUMENTS TO <br />TRANSFER AND ASSIGN THE EASEMENTS TO THE SOUTHERN <br />CALIFORNIA EDISON COMPANY <br />DATE: August 24, 2007 <br />BACKGROUND: <br />In November 2004, the City and Southern California Edison Company ("Edison") settled a <br />"friendly' eminent domain action to acquire electric distribution facilities in the West Valley <br />Boulevard area. As part of the settlement, two (2) electric transmission easements needed by <br />Edison were inadvertently included in the Final Order of Condemnation and were transferred to the <br />City. Edison recently discovered the error and contacted City staff to discuss possibly vacating the <br />easements and assigning them over to Edison. <br />DISCUSSION/ANALYSIS: <br />City staff confirmed that the easements in question are not needed by the City for it's electric utility <br />services. The easements have not been used by the City since they were acquired in 2004. Also, <br />there are no public facilities located within the easements. Based on these facts, the City can use <br />the summary vacation procedure contained in the California Streets and Highways Code to vacate <br />the easements. The summary vacation procedure consists of adoption of a resolution that <br />incorporates specific findings regarding the easements. City staff has prepared the proposed <br />Resolution, attached to this report as Exhibit 'W'. Once the easements are vacated, the City can <br />proceed with assigning them over to Edison. The assignment documents are attached to this <br />report as Exhibit "B." To expedite the entire process, City staff recommends that the City Council <br />authorize the City Manager to execute the assignment documents after the easements have been <br />vacated. <br />
