CITY OF COLTON ITEM #4 <br />SUPPLEMENTAL AGENDA REPORT <br />FOR COUNCIL MEETING OF NOVEMBER 6, 2007 <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />FROM: Daryl Parrish, City Manager <br />SUBJECT: Approve and Adopt Amended Resolution for the City Clerk <br />DATE: November 6, 2007 <br />BACKGROUND: <br />During the last few months, the City Clerk met with the Council negotiations sub -committee to <br />discuss a salary increase for the non-statutory/non-elected duties assigned to the position of City <br />Clerk for the current term of office. After meetings with the City Clerk and City staff, a salary of <br />$5,036 has been agreed upon (this includes the $400 auto allowance). <br />DISCUSSION/ANALYSIS: <br />The proposed salary of $5,036 was derived by adding 3% per year to the current salary of $4,095 <br />and compounding it for seven years; the City is eliminating the $400 auto allowance and adding it <br />to the proposed salary (the same was done for the directors some time ago) making the entire <br />monthly salary $5,436. The City Clerk will maintain a mileage log and submit City -related business <br />mileage in excess of fifty (50) miles used in a personal vehicle for reimbursement pursuant to the <br />City's AB 1234 reimbursement policy and current practice for the Executive Unit; said <br />reimbursement will be non-taxable. In addition to the proposed salary for her non-statutory/non- <br />elected duties, the City Clerk will continue to receive the $370 stipend provided for by Ordinance <br />1572 (Colton Municipal Code Section 2.12.010) for her statutory duties as an elected official. <br />Because of the additional compensation, the City Clerk's duties have been and will continue to be <br />bifurcated. The incumbent will continue to perform the non -statutory duties traditionally associated <br />with the City Clerk in Colton, and shall be properly compensated for those supplemental duties <br />during this term of office. Upon the completion of the current term of office in 2008, regardless of <br />who is elected, supplemental compensation and benefits for the non -statutory duties will be subject <br />to the discretion of the City Council. <br />The City Clerk's supplemental duties include all duties assigned to the City Clerk which are not <br />those legal duties and responsibilities specific to the office and position of elected City Clerk, as <br />described in the California Government Code, as may be amended from time to time, including, but <br />not limited to, Section 34080, Section 36500 et seq., Section 36932 et seq. and Section 40800, et <br />seq. Specifically, the elected City Clerk, or such deputies as may be appointed by the City Clerk, is <br />statutorily required to attend all meetings of the City Council, keep accurate records of City Council <br />proceedings, retain custody of the City Seal, keep an ordinance and resolution book, and record all <br />ordinances and resolutions in it with certifications attached. <br />As a result of the salary increase and as recommended by the negotiations sub -committee, the <br />City Clerk will be evaluated on an annual basis by the City Manager (evaluations can be completed <br />at any time should there be a need to). Should the City Clerk not perform up to the performance <br />standards noted by the City Manger in the evaluation, the City Manager will retain the right to <br />remove the non-statutory/non-elected duties and decrease the salary to the elected official monthly <br />stipend of $370 for the statutory duties. The first evaluation will be due by July 1, 2008; an <br />evaluation can be done prior to this date at the discretion of the City Manager. <br />RV PUB\DDERLETH\739688.8 <br />
