ITEM #21 <br />CITY OF COLTON <br />AGENDA REPORT <br />FOR THE CITY COUNCIL MEETING OF AUGUST 5, 2008 <br />TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS <br />FROM: MARITZA TAPIA, INTERIM PUBLIC WORKS DIRECTOR <br />SUBJECT: AUTHORIZE THE CITY MANAGER TO EXECUTE AN EARLY <br />COMMENCEMENT OF GRADING AGREEMENT WITH AMB <br />PROPERTY CORPORATION FOR TRACT NO. 18250. <br />DATE: JULY 21, 2008 <br />BACKGROUND: <br />Tentative Tract Map 18250 consists of a 94.18 acre Industrial Business Park development of <br />buildings. The development is located on the northerly side of the Santa Ana River and <br />southeasterly side of Riverside Avenue. The proposed tract is being constructed by AMB Property <br />Corporation (Developer). <br />ANALYSIS/DISCUSSION: <br />A request for early commencement of grading was submitted by the Developer, which would allow <br />the Developer to grade its property prior to the recordation of the tract map for the property. The <br />City is requiring the Developer to enter into a grading agreement to assure completion of the <br />grading operation. Bonds for Landscaping/ Re -Vegetation and Grading are also required as part of <br />the agreement. As required, the City has received 100 % the of Landscaping/ Re -Vegetation Bond <br />for the amount of $484,156.25 and 150% of the Grading Bond for the amount of $ 726,234.38. <br />Staff recommends the Council authorize the City Manager execute the attached agreement, Exhibit <br />C, to allow development of Tract 18250 to commence. <br />ENVIRONMENTAL IMPACT: <br />An Environmental Impact Report was prepared and circulated as part of the Tract Development. <br />CONFLICT OF INTEREST <br />Exact Business Name: AMB Property Inc. <br />President or Equal: Larry Cochrun <br />Contact Representative: Larry Cochrun <br />
