CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF AUGUST 5, 2008 <br />ITEM #14 <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />FROM: BOB MILLER, CHIEF OF POLICE <br />SUBJECT: APPROVE ANIMAL HOUSING SERVICES AGREEMENT BETWEEN <br />THE CITY OF SAN BERNARDINO ANIMAL SHELTER AND THE CITY <br />OF COLTON FOR FISCAL YEAR 2008/09 (CONTRACT EFFECTIVE <br />JULY 1, 2007 THROUGH JUNE 30, 2010). <br />DATE: July 17, 2008 <br />BACKGROUND: <br />The City of Colton currently utilizes the City of San Bernardino Animal shelter for the housing of <br />animals found within the City. The police department desires to continue this arrangement <br />through the renewing of our existing contract. <br />DISCUSSION / ANALYSIS: <br />The City of Colton does not maintain facilities for the housing of animals found within the City <br />limits, or for those required to be quarantined through an order of the animal control officer. The <br />City of San Bernardino has previously entered into an agreement with the City of Colton to provide <br />those services at their facilities. Additionally, the City of Colton contracts our animal control <br />services to the City of Grand Terrace who also contracts with the City of San Bernardino for <br />animal housing services. The proposed agreement (attached) is the City of San Bernardino's <br />standard contract and is required by San Bernardino in order to continue the service. The <br />Indemnification section contains the same language as in the prior '04-'07 contract. However, the <br />agreement requires the City of Colton to indemnify the City of San Bernardino while the City of <br />San Bernardino does not provide the City of Colton indemnification.
