Zamora, Community Development Director Candace Cassel, Economic Development Director SUBJECT: Consideration and Approval of City Resolution and Agency Resolution No. 876 Adopting Local Guidelines for Implementing the California Environmental Quality Act (Pub. Resources Code §§ 21000 Et Seq.) DATE: September 4, 2008 BACKGROUND: Annually, the City and Redevelopment Agency receive updates to the California Environmental Quality Act (CEQA) Guidelines. These updates are provided to us by the offices of Best, Best and Krieger (BB&K), attorneys for the City of Colton and Agency. It has been standard practice for the City and Agency to adopt the updates by City Council and Agency Resolution to remain in compliance with State Environmental Law. DISCUSSION/ANALYSIS: The City Council and Agency Board are requested to adopt the attached Resolutions amending and adopting Local Guidelines for implementing CEQA and repeal earlier Resolutions addressing the same. The proposed amendments are consistent and compatible with the policies of the State of California, the City of Colton and the Agency. FINANCIAL IMPACT: There is no financial impact to the General Fund. The requested action is a text change only. A financial impact, unknown at this time, could occur should the City not adopt the Resolution amending CEQA Guidelines, and be challenged in a court of law for CEQA non-compliance. ENVIRONMENTAL IMPACT: None CONFLICT OF INTEREST: N/A CONSISTENCY WITH IMPLEMENTATION PLAN: Adoption of Agency Resolution 876 enables the Agency to complete its goals and objectives in compliance with the California Environmental Quality Act.
