ITEM #21 <br />CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL AND REDEVELOPMENT AGENCY MEETING OF SEPTEMBER 16, 2008 <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />HONORABLE AGENCY CHAIRPERSON AND BOARDMEMBERS <br />FROM: David R. Zamora, Community Development Director <br />Candace Cassel, Economic Development Director <br />SUBJECT: Consideration and Approval of City Resolution and Agency Resolution <br />No. 876 Adopting Local Guidelines for Implementing the California <br />Environmental Quality Act (Pub. Resources Code §§ 21000 Et Seq.) <br />DATE: September 4, 2008 <br />BACKGROUND: <br />Annually, the City and Redevelopment Agency receive updates to the California Environmental <br />Quality Act (CEQA) Guidelines. These updates are provided to us by the offices of Best, Best and <br />Krieger (BB&K), attorneys for the City of Colton and Agency. It has been standard practice for the <br />City and Agency to adopt the updates by City Council and Agency Resolution to remain in <br />compliance with State Environmental Law. <br />DISCUSSION/ANALYSIS: <br />The City Council and Agency Board are requested to adopt the attached Resolutions amending <br />and adopting Local Guidelines for implementing CEQA and repeal earlier Resolutions addressing <br />the same. <br />The proposed amendments are consistent and compatible with the policies of the State of <br />California, the City of Colton and the Agency. <br />FINANCIAL IMPACT: <br />There is no financial impact to the General Fund. The requested action is a text change only. A <br />financial impact, unknown at this time, could occur should the City not adopt the Resolution <br />amending CEQA Guidelines, and be challenged in a court of law for CEQA non-compliance. <br />ENVIRONMENTAL IMPACT: <br />None <br />CONFLICT OF INTEREST: <br />N/A <br />CONSISTENCY WITH IMPLEMENTATION PLAN: <br />Adoption of Agency Resolution 876 enables the Agency to complete its goals and objectives in <br />compliance with the California Environmental Quality Act. <br />
