ITEM #7 <br />CITY OF COLTON <br />AGENDA REPORT <br />FOR THE CITY COUNCIL MEETING OF OCTOBER 20, 2009 <br />TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS <br />FROM: MARITZA TAPIA, INTERIM PUBLIC WORKS DIRECTOR <br />SUBJECT: APPROVE RESOLUTION INCREASING THE FISCAL YEAR <br />2009/2010 CAPITAL BUDGET BY $350,000; AUTHORIZE THE <br />EXECUTION OF THE FINAL CHANGE ORDER FOR $359,437.27; <br />FOR THE VETERANS PARK SPORTS COMPLEX PROJECT. <br />DATE: OCTOBER 13, 2009 <br />BACKGROUND: <br />The Veterans Park Sports Complex Project is part of the CIP (Capital Improvement Program). The <br />Veterans Park Sports Complex Project is contained in a 13.54 -acre park. This project will include <br />the modernization of three baseball/softball fields and basketball courts. These fields will have the <br />following amenities: seating, sunken dugouts, backstops, concession building, and outfield fencing. <br />The park's open space will be provided the following amenities: two play structures, a splash pad, <br />horse shoe pits, basketball courts, and miniature soccer fields. Purchase of play structures and splash <br />pond was awarded by Council action on November 4, 2008. <br />The Design Review Committee recommended approval of the project on the April 2, 2007 meeting. <br />The project was conditionally approved by the Planning Commission on August 26, 2008 and a <br />Notice of Determination was filed with the Clerk of the Board of Supervisors on August 29, 2008. <br />ANALYSIS/DISCUSSION: <br />On September 16, 2008, the City Council authorized solicitation of bids for Veterans Park Sport <br />Complex Project. Subsequently on November 18, 2008, Council action authorized award of a <br />construction agreement to C.S. Legacy Construction, Inc., in the amount of $3,046,064. The project <br />was completed satisfactorily in the amount of $3,405,501.20, which is $362,187.27 (11.8%) above <br />the original contract. Staff requests authorization to award the attached final change order, Exhibit <br />A. Some of the awarded improvements included landscaping and require the contractor to maintain <br />the improvements for a ninety day period; retention will be retained until the maintenance period is <br />completed. Staff will bring back a Notice of Completion once this maintenance period has passed. <br />The ground breaking ceremony is being planned for November; staff will post the event's flyers at <br />various city facilities and post the event on Channel 3 and the city website. <br />ENVIRONMENTAL IMPACT: <br />The project was conditionally approved by the Planning Commission on August 26, 2008 and a <br />
