STAFF REPORT ITEM NO. 0 3 DATE: FEBRUARY 2, 2010 TO: HONORABLE MAYOR AND CIT C , FROM: ROD FOSTER, CITY MANAGER PREPARED BY: BILL SMITH, COMMUNITY SERVICES DIRECTOR SUBJECT: MODIFICATION OF THE SBPEA MID -MANAGER BARGAINING UNIT AND THE EXECUTIVE BARGAINING UNIT RECOMMENDED ACTION It is recommended that City Council adopt Resolution R-05-10 approving the attached Side Letter to the Memorandum of Understanding with the San Bernardino Public Employees Association (SBPEA), modifying the Mid -Manager Bargaining Unit, and adding the position of Chief Deputy City Clerk to the Executive Bargaining Unit. GOAL STATEMENT The proposed action will support the City's goal to ensure that all employees are adequately represented within the appropriate bargaining unit. BACKGROUND The position of Chief Deputy City Clerk is currently represented by the Mid -Manager Unit of the SBPEA. Due to the nature of duties for this position, including interaction with City Council and executive staff, it is desirable to have this position included within the scope of the Executive Unit to ensure the status of the position as a confidential employee. As such, staff recommends that the SBPEA Mid -Manager Unit, and the Executive Unit, both be modified to reflect this change. ISSUES/ANALYSIS The SBPEA has been contacted, and it has represented to the City that it does not object to this modification. The incumbent in this position has also been advised of this intent, and the employee is supportive of this action. Subsequent to this contact, the proposed Side Letter has been officially approved by the SBPEA. Additionally, staff is working on the establishment of a stand-alone "confidential" unit. As such, this will ensure that all related MOU provisions are associated with appropriate unit.
