STAFF REPORT <br />ITEM NO. 0 3 <br />DATE: FEBRUARY 2, 2010 <br />TO: HONORABLE MAYOR AND CIT C , <br />FROM: ROD FOSTER, CITY MANAGER <br />PREPARED BY: BILL SMITH, COMMUNITY SERVICES DIRECTOR <br />SUBJECT: MODIFICATION OF THE SBPEA MID -MANAGER BARGAINING <br />UNIT AND THE EXECUTIVE BARGAINING UNIT <br />RECOMMENDED ACTION <br />It is recommended that City Council adopt Resolution R-05-10 approving the attached Side <br />Letter to the Memorandum of Understanding with the San Bernardino Public Employees <br />Association (SBPEA), modifying the Mid -Manager Bargaining Unit, and adding the position of <br />Chief Deputy City Clerk to the Executive Bargaining Unit. <br />GOAL STATEMENT <br />The proposed action will support the City's goal to ensure that all employees are adequately <br />represented within the appropriate bargaining unit. <br />BACKGROUND <br />The position of Chief Deputy City Clerk is currently represented by the Mid -Manager Unit of the <br />SBPEA. Due to the nature of duties for this position, including interaction with City Council and <br />executive staff, it is desirable to have this position included within the scope of the Executive <br />Unit to ensure the status of the position as a confidential employee. As such, staff recommends <br />that the SBPEA Mid -Manager Unit, and the Executive Unit, both be modified to reflect this <br />change. <br />ISSUES/ANALYSIS <br />The SBPEA has been contacted, and it has represented to the City that it does not object to this <br />modification. The incumbent in this position has also been advised of this intent, and the <br />employee is supportive of this action. Subsequent to this contact, the proposed Side Letter has <br />been officially approved by the SBPEA. <br />Additionally, staff is working on the establishment of a stand-alone "confidential" unit. As such, <br />this will ensure that all related MOU provisions are associated with appropriate unit. <br />
