ITEM NO. 08 STAFFP , R r DATE: AUGUST 3, 2010 TO: HONORABLE MAYOR AND CITY COUNCIL AGENCY CHAIR AND BOARD MEMBERS FROM: ROD FOSTER, CITY MANAGER/EXECUTIVE DIRECTOR PREPARED BY: MARK TOMICH, DEVELOPMENT SERVICES DIRECTOR SUBJECT: APPROVE PROFESSIONAL SERVICES AGREEMENT WITH RBF CONSULTING FOR COMPLETION OF A HABITAT CONSERVATION PLAN (HCP) FOR THE WEST VALLEY SPECIFIC PLAN AMENDMENT AREA RECOMMENDED ACTION It is recommended that the City Council terminate the existing Professional Services Agreement with PBS&J for HCP services and approve the Professional Services Agreement with RBF Consulting for completion of the Habitat Conservation Plan (HCP) in the West Valley Specific Plan Amendment Area ("WVSPA") in an amount not -to -exceed Thirty Five Thousand Eight Hundred Dollars ($35,800). GOAL STATEMENT The proposed action will support the City's goal to provide for economic opportunities for the City of Colton that will be created as a result of the adoption of the West Valley Specific Plan Amendment Area. BACKGROUND At the meeting of June 19, 2007, the City Council and Redevelopment Agency awarded a contract to Michael Brandman Associates (MBA) to complete the Environmental Impact Report (EIR) under CEQA for the West Valley Specific Plan Amendment. Included within the scope of services was the development of a Habitat Conservation Plan (HCP) to address mitigation of impacts on identified habitat for the Delhi Sands Flower -Loving Fly ("DSF") in the project area. The original contract term was through December 31, 2008 and an original contract amount was not to exceed $362,420. At the meeting of December 16, 2008, the City Council and Redevelopment Agency approved a 1St Amendment to the contract with MBA providing an additional scope of work needed to complete the development of the HCP, to extend the term of the agreement through December 31, 2009 and to increase the contract by $30,000.
