ITEM NO. 12 <br />STAFF REPORTRATIO <br />DATE: NOVEMBER 16, 2010 <br />TO: HONORABLE MAYOR AND CITY COUNr <br />FROM: ROD FOSTER, CITY MANAGER <br />PREPARED BY: VIJAY SINHA, PUBLIC WORKS AND UTILITY SER IC S <br />DIRECTOR (� <br />SUBJECT: 9TH STREET RAIL RELOCATION PROJECT GRANT <br />RECOMMENDED ACTION <br />It is recommended that the City Council approve the attached resolution in support of the City's <br />request for federal funds for the 9`" Street Rail Line Relocation Project. <br />GOAL STATEMENT <br />The proposed action will support the City's goal to improve circulation and pedestrian safety. <br />BACKGROUND <br />On May 4, 2010, Council authorized execution of a Memorandum of Understanding between the <br />City of Colton, San Bernardino Associated Governments (SANBAG), Union Pacific Railroad <br />Corporation and BNSF Railway Company. The agreement identified four additional <br />Colton/SANBAG improvements, one of which was the 9t' Street Improvement Project. The <br />city's obligation in the delivery of this improvement is to provide Union Pacific with the <br />required right-of-way near Fogg Street to relocate its 9t` Street line. <br />Congress authorized Section 9002 of SAFETEA-LU which set aside $350 million per year for <br />each fiscal year between 2006-2009 for the Federal Railroad Administration (FRA) Rail Line <br />Relocation and Improvement Capital Grant Program. However, Congress did not appropriate the <br />funds until 2008. Under this program a city, county or state is an eligible applicant for <br />construction projects that improve the route or structure of a rail line and 1) involves a vertical or <br />lateral relocation of any portion of the rail line or 2) is carried out for the purpose of mitigating <br />the adverse effects of rail traffic on safety, motor vehicle traffic flow, community quality of life <br />and economic development. This fiscal year $20,502,500 is available for this program's <br />competitive grant cycle. <br />
