CITY OF COLTON <br />,,,,or90 rata ►�.. <br />a <br />AGENDA REPORT 1887 <br />FOR COUNCIL MEETING JUNE 15, 993 a 0.41 S +% <br />TO HONORABLE MAYOR AND CITY COUNCIL <br />FROM: JOHN HUI'TON <br />PUBLIC WORKS DIRECTOR j <br />SUBJECT: PUBLIC HEARING TO DETERMINE SQUIRES LU <br />VACATE AN ALLEY DESCRIBED AS THE WESTE <br />WEST BY 9TH STREET, ON THE EAST BY 10TH <br />STREETS <br />BACKGROUND <br />DATE: JUNE 10, 1993 <br />ER COMPANY'S REQUEST TO <br />Y 275 FEET BOUNDED ON THE <br />GREET, BETWEEN "G" AND "H" <br />At the January 12, 1993 Planning Commission meeting, it was recommended for <br />conditional approval of the above referenced subject. Squires currently has <br />an approved encroachment permit with a single extension that expires June 27, <br />1993. The Vacation approval is subject to the conditions of the planning <br />commission, which includes the retention of eas ment rights for utility <br />purposes, and accessibility for public services. esolution for "intention <br />to vacate" was adopted May 18, 1993 (Resolution # 35-93). <br />DISCUSSION <br />Attached is a copy of the encroachment/vacation application accompanied by a <br />letter submitted by Stan Paxson of Squires Lumber, copy of Resolution for <br />"intention to vacate" (R-35-93), copy of permit and extension, Plat/Alley <br />Vacation Plan and a copy of the conditions of approval prepared by the <br />planning commission. <br />As early town records of Colton indicate, the alley was formed from a <br />dedication of early bordering property owners and one of the present owners <br />of the property desires the alley vacation due to security' and safety <br />reasons. <br />In addition, to Mr. Paxson as one property owner, <br />three fourths of the alley frontage, two other <br />remaining alley frontage. <br />Several concerns have been raised by one of the Ott <br />a variety of issues and both parties have agreed <br />staff in hopes of resolving the issues before <br />considered. <br />abuts approximately <br />rty owners abut the <br />ar owners of which cover <br />to meet along with City <br />the public hearing is <br />&I &- -Z 4 <br />IF <br />
