CONFIDENTIAL: <br />ATTORNEY-CLIENT PRIVILEGE <br />FROM: Julie Hayward Biggs, City Attorney <br />TO: City Council of the City of Colton <br />DATE: June 4, 1996 <br />On May 7, 1996, the City Council adopted Interim Ordinance <br />No. 0-12-96, imposing a moratorium on adult uses and an exception process <br />allowing applications for exceptions as to adult uses within the City. Ordinance <br />No. 0-12-96 was enacted pursuant to Government Code section 65858 to allow the <br />City to review, study and possibly revise its existing adult business regulations. <br />After the adoption of Ordinance No. 0-12-96, the City hired LSA <br />Associates, Inc., planning and zoning consultants, to conduct a zoning study and <br />an inventory of potential adult use locations taking into account existing zones and <br />dispersal requirements. The study has been commenced, but is not yet complete, <br />necessitating in the extension of Ordinance No. 0-12-96. <br />The Community Development staff also is in the process of creating a <br />form to apply for an exception permit. At the present time, the existing <br />Development Application form is available to apply for an exception permit. <br />This report is made in compliance with Government Code section <br />65858, subdivision (d). <br />ITEM 43 <br />
