1`' <br />AGENDA REPORT <br />For the Council Meeting of February 18, 1997 <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />APPROVAL: MALIK FREEMAN, CITY MANAGER <br />FROM: THOMAS K CLARKE, UTILITY DIRECTOR --'C � <br />SUBJECT: APPROVAL OF RESOLUTION DESIGNATING THE UTILITY DIRECTOR AS THE CITY OF <br />COLTON'S AUTHORIZED REPRESENTATIVE TO SIGN & FILE A FINANCIAL ASSISTANCE <br />APPLICATION FOR A LOAN FROM THE STATE WATER RESOURCES CONTROL BOARD <br />FOR THE EXPANSION & TITLE 22 REPAIRS TO THE SECONDARY WASTEWATER <br />TREATMENT PLANT <br />[DATE: FEBRUARY 5, 1997 <br />BACKGROUND: <br />On April 7, 1995, the Regional Water Quality Control Board (RWQCB) adopted Cease and Desist Order No. <br />95-36 (CDO 95-36) requiring the City to stop issuing connections to the sewer system, to prepare a report of <br />deficiencies at the Wastewater Treatment Plant (Title 22 Report) and to develop plans and schedules for <br />making repairs and improvements -identified in the Title 22 Report. On August 15, 1995, the City completed <br />the Title 22 Report and submitted it to the RWQCB. On August 18, 1995, the City Council adopted Plans <br />and Schedules for Compliance with CDO No. 95-36. <br />DISCUSSION/ANALYSIS: <br />The State Board of Water Resources requirements for submission of a loan application include a resolution <br />from the applying agency, designating an authorized representative to act on that agency's behalf. The Utility <br />Director is responsible for enforcing the City's compliance with CDO 95-36. Therefore, the Utility Director is <br />being recommended as the City's authorized representative: <br />ALTERNATIVES: <br />The Council may choose to appoint the City Manager or a Council Member as the City's authorized <br />representative. <br />FINANCIAL IMPACT: <br />The City of Colton is being required to expand its secondary capacity, as well as make repairs to its existing <br />secondary facilities. The cost of the design, expansion and repairs are estimated at $16,367,000.00 . The <br />City of Colton may either: 1) Obtain a State Revolving Fund loan at a low interest rate; or 2) Obtain bonding <br />at a higher interest rate than the State. At this time, staff is pursuing both options to ensure that funding is <br />available prior to construction. <br />RECOMMENDATION': <br />Staff recommends that Council adopt the attached Resolution Designating the Utility Director as the City of <br />Colton's Authorized Representative to Sign and File a Financial Assistance Application for a Loan from the <br />State Water Resources Control Board for the Expansion and Title 22 Repairs to the Secondary Wastewater <br />Treatment Plant. <br />
