CITY OF COLTON <br />AGENDA REPORT <br />For the Council Meeting of February 3, 1998 <br />TO: HONORABLE MAYOR AND CITY COU CIL <br />APPROVAL: HENRY T. GARCIA, CITY MANAGE <br />FROM: THOMAS K. CLARKE, UTILITY DIRECTOR <br />SUBJECT: APPROVAL OF AMENDMENT TO THE PRETREATMENT ORDINANCE <br />DATE: <br />21, 1998 <br />BACKGROUND: <br />The Pretreatment Program began in 1982 as a condition of the City of Colton's NPDES Permit <br />issued by the Regional Water Quality Control Board (RWQCB) for operation of its Wastewater <br />Treatment Plant. Due to frequent changes in the Federal and State regulations for <br />Pretreatment, ,the City had to amend its Pretreatment Ordinance in January of each year after <br />1983. In April, 1994 Council approved the last amendment to the Pretreatment Ordinance. <br />No subsequent changes were required since that time. <br />DISCUSSION/ANALYSIS: <br />The RWQCB recently issued a new NPDES Permit to the Colton/San Bernardino Joint Powers <br />Authority for the RIX Regional Wastewater Tertiary Treatment Facility, which included both <br />City's secondary Wastewater Treatment Plants. The new NPDES Permit supersedes the <br />individual permits issued to each City, thus making the Pretreatment Ordinances invalid. <br />The Colton/San Bernardino Joint Powers Authority has had a comprehensive Pretreatment <br />Ordinance developed which has been reviewed by staff and the City Attorney. The revised <br />Pretreatment Ordinance allows each City to remain the sole responsible enforcement authority <br />over the secondary wastewater discharged within each jurisdiction. It also provides for each <br />City's indemnification if the other fails to adequately enforce the Federal and State <br />Pretreatment regulations. The local limits were also adjusted according to Federal and State <br />regulations, <br />FINANCIAL IMPACT: <br />Since 1983, the cost for operating the Pretreatment Program has been included as a portion of <br />the commercial/industrial sewer rates for both Colton and Grand Terrace. The additional cost <br />for the changes made in the new Ordinance will be included in the commercial/industrial sewer <br />rates proposed for FY98-99. <br />RECOMMENDAI"ION: <br />Staff recommends that Council approve the waiving of, the first reading of the Pretreatment <br />Ordinance. <br />Report Prepared By: Lorraine June <br />Page 1.of 1 <br />Item # 25 <br />
