Garcia, City Manage <br />FROM: Patricl(;G�we, Acting Chief of Police <br />SUBJECT: An agreement with San Bernardino County Department of Public Health <br />for Enforcement of California Smokefree Workplace Act. <br />DATE: May 20, 1998 <br />BACKGROUNDe The City currently has an agreement with the county of San Bernardino <br />Department of Public Health for the enforcement of the California Smokefree Workplace Law. <br />This agreement is of no cost to the City of Colton. The agreement is for a period of two years. <br />The current agreement expires on July 16, 1998. The agreement currently needs to be renewed to <br />contmue the current enforcement of the Smokefree Workplace Act. <br />DISCUSSION/ANAT,YISIS: The state of California enacted an anti-smoking law under Labor <br />Code Section 6404.5 effective January 1, 1995, to Protect employees by eliminating smoke in <br />enclosed work places. The San Bernardino County Department of Public Health has a specific <br />division dedicated to enforcing the anti-smoking laws, including the provisions of the Labor Code <br />Section 6404.5, and currently does so for various cities within the county at no cost. <br />The city of Colton entered into an agreement with the County Department of Public Health as of <br />July 16, 1996, for a two-year period. Due to the expiration on July 16, 1998, it is time to renew <br />the agreement. The agreement proposed by the County Department of Public Health is the same as <br />the agreement previously signed and will again be for a two-year period. The agreement submitted <br />by County Department of Public Health has been reviewed.by Best, Best & Krieger. They have <br />found the agreement to be in proper form. <br />If the current agreement is approved, it will extend the agreement through July, 2000.'
