C , Acting Chief of Police <br />SUBJECT: Proposed Municipal Code Chapter 10.40 <br />Tow Truck Franchise Ordinance <br />J DATE: April 21, 1998 <br />BACKGROUND: The City currently has no municipal code or ordinance governing the <br />franchise of tow trucks serving the City of Colton. Authorization to be an official tow for <br />the City of Colton Police Department is granted under General Order number 4.130 of <br />the Police Department. This gives the authority to the police department to select tow <br />agencies. <br />DISCUSSION/ANALYSIS: General Order number 4.130 states that all requests to be <br />added to the tow roster must be in writing. Such requests when received will be dated <br />and retained by the Services Division Commander. Vacancies will be filled as needed <br />from these requests in the order received provided the tow service meets the <br />department's requirements at the time the vacancy is to be filled. The General Order <br />states that it is the intent of the City of Colton to maintain two to four tow service <br />operations to perform tow services on behalf of the City of Colton Police Department. <br />Those agencies operating within the limits of Colton will be given priority in their <br />selection. <br />The proposed Municipal Code provides a structured method of selecting and <br />maintaining franchise tow truck operations. This sets the condition of franchisees and <br />provides revenue to the City to mitigate the cost of towing and storing vehicles. This <br />code complements the existing police department policy governing the rotation system of <br />tow services and provides criteria and methods for franchise revocation. <br />See attached proposed ordinance. <br />ENVIRONMENTAL IMPACT: This is not a project pursuant to California <br />Environmental Quality Act. <br />Item # 21 <br />
