GarciXymanage FROM: avi . amonity Development Director SUBJECT: Appeal to the City Council regarding the Planning Commission's Decision to Deny File Index Number DCV -33-99, a Request for an Architectural and Site Plan Review, Environmental Determination, Conditional Use Permit to Establish and Operate a Solid Waste Collection, Processing, Recycling Center and Transloading Facility, and a Major Variance to Permit a Metal Building and to Reduce the Required 25% Landscaping. DATE: August 4, 1999 BACKGROUND: On July 27, 1999, the Planning Commission considered and denied the applicant's request from Taormina Industries, Inc. for a Major Variance to permit a metal building proposed to be located in the Santa Ana River Redevelopment Project Area Specific Plan. After receiving public testimony, the Commission considered and approved the applicant's request with the exception of the Major Variance to permit a metal building. Attached are the Minutes of the Planning Commission Meeting of July 27, 1999 (Attachment A). Upon denial by the Planning Commission, the applicant was informed of the ten-day appeal period. On July 28, 1999, the applicant filed an official appeal of the Commission's denial of a Major Variance to allow a metal building in the Santa Ana River Redevelopment Project Area Specific Plan (Attachment B). DISCUSSION/ANALYSIS: Attached for the Council's review is a copy of the Staff Report (Attachment C) which provided Staff's analysis of the proposed project at the Commission hearing. As noted in the report, under Zoning Consistency, under Section 4.8 of the Santa Ana River Redevelopment Project Area Specific Plan, new building design guidelines require each industrial building to be of masonry block or concrete tilt -up construction. The applicant is proposing to relocate to the project site, an existing metal building (approximately 12,000 squarefeet) to serve as the tipping and processing center. The applicant has agreed to modify the metal building with architectural amenities that will enhance its appearance and compatibility to its surroundings. After receiving public testimony, the Planning Commission determined that the proposed metal building was not consistent with the guidelines of the Santa Ana River Redevelopment Project Area Specific Plan and, therefore, denied the applicant's request of a Major Variance to allow the metal building. ALTERNATIVES: Deny the appeal by the applicant, requiring Taormina Industries to construct an approximately 12,000 square foot industrial building of masonry block or concrete tilt -up construction.
