La Cadena Dr. Colton, CA 92324 Dear Mr. Garcia: The purpose of this letter is request that the City Attorney, Best, Best & Krieger (BB&K) and/or their agents withdraw themselves from 01/05/99 Council meeting Item #15, "Settlement Agreement with Abe Beltran, Regarding FPPC Administrative Matter." A controversial public matter of concern under consideration. BB&K appears to be in the "center" of this controversial "Beltran" issue. BB&K's involvement in the Beltran matter gives rise to, at least, the appearance of a conflict of interest, for the following least four (4) reasons: 1. BB&K is in a position to make, participate in, or use their official position as City Attorney to advise, thereby, influencing the Council on this "Beltran" governmental decision; 2. It is foreseeable that any decision will affect BB&K's economic interest, since they are paid by the City; 3. The effect of the decision on BB&K's official's economic interest may be material, financially; 4. The effect of the decision on BB&K's economic interest will be distinguishable from its effect on the public generally. BB&K could escape any potential civil liability at the expense of the taxpayers, if a claim does, in fact, exist and/or is made by Beltran in relation to his FPPC Proceeding. My concern is also for the possible adverse legal consequences to Councilmembers who may vote "YES" on this issue, relying on BB&K's advice.
