Zara, C munity Development Director <br />SUBJECT: Resolution Authorizing Amending and Updating the City's CEQA <br />(California Environmental Quality Act) Guidelines. <br />I DATE: June 15, 1999 <br />BACKGROUND: <br />Annually, the City receives updates to the CEQA (California Environmental Quality Act) <br />Guidelines. These are provided to us through the offices of Best, Best and Krieger <br />(BB&K), attorney for the City of Colton. It has been standard practice for the City to <br />adopt the updates by City Council Resolution, so that we will remain in compliance with <br />State Environmental Law. <br />DISCUSSION/ANALYSIS: <br />The City Council is requested to adopt the attached Resolution, amending and adopting <br />local guidelines for implementing the California Environmental Quality Act, and repeal <br />earlier Resolutions addressing the same. <br />The proposed amendments are consistent and compatible with the policies of the State of <br />California and the City of Colton. The attached memorandum from BB&K, dated April <br />21, 1999, details the revisions to CEQA that are relevant to the City of Colton. <br />ALTERNATIVES: <br />The City Council has the authority to deny the requested update to the City's CEQA <br />Guidelines. To do so will place the City out of compliance with the current CEQA. The <br />requested action, if approved, will keep the City in compliance with the State CEQA, and <br />legally defensible if challenged in a court of law. <br />FINANCIAL IMPACT: <br />No impact to the General Fund. The requested action is a text change only. A Financial <br />Impact, unknown at this time, could occur, should the City not adopt the Resolution <br />amending CEQA Gu*lines, and be challenged in a court of law for CEQA non- <br />mmunity Development Director Item # I I <br />
