Zara, C munity Development Director SUBJECT: Resolution Authorizing Amending and Updating the City's CEQA (California Environmental Quality Act) Guidelines. I DATE: June 15, 1999 BACKGROUND: Annually, the City receives updates to the CEQA (California Environmental Quality Act) Guidelines. These are provided to us through the offices of Best, Best and Krieger (BB&K), attorney for the City of Colton. It has been standard practice for the City to adopt the updates by City Council Resolution, so that we will remain in compliance with State Environmental Law. DISCUSSION/ANALYSIS: The City Council is requested to adopt the attached Resolution, amending and adopting local guidelines for implementing the California Environmental Quality Act, and repeal earlier Resolutions addressing the same. The proposed amendments are consistent and compatible with the policies of the State of California and the City of Colton. The attached memorandum from BB&K, dated April 21, 1999, details the revisions to CEQA that are relevant to the City of Colton. ALTERNATIVES: The City Council has the authority to deny the requested update to the City's CEQA Guidelines. To do so will place the City out of compliance with the current CEQA. The requested action, if approved, will keep the City in compliance with the State CEQA, and legally defensible if challenged in a court of law. FINANCIAL IMPACT: No impact to the General Fund. The requested action is a text change only. A Financial Impact, unknown at this time, could occur, should the City not adopt the Resolution amending CEQA Gu*lines, and be challenged in a court of law for CEQA non- mmunity Development Director Item # I I
