I I ORDINANCE NO. 2 AN ORDINANCE OF THE CITY OF COLTON, CALIFORNIA ADDING CHAPTER 3 5.38 TO THE COLTON MUNICIPAL CODE IN ORDER TO ENACT REGULATIONS 4 AND ADOPT A FEE SCHEDULE FOR MOTION PICTURE PRODUCTION 5 ACTIVITIES 6 WHEREAS, the City Council of the City of Colton ("City') finds and determines that the making of motion 7 pictures could be beneficial to the economic well being of the State of California, City and the needs of society; 8 and 9 WHEREAS, the City desires to support the motion picture industry by actively participating in and with the film 10 commission in their effort to locate filming within the Inland Empire, more specifically Colton; and T1 WHEREAS, under the City's police powers pursuant to the California Constitution Article XI, Section 7 the City 12 is authorized to establish a Film Permit the city limits of Colton; 13 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON DOES HEREBY ORDAIN AS 14 FOLLOWS: 15 Section 1. Chapter 5.38 is hereby added to the Colton Municipal Code to read as follows: 16 Chapter 5.38 17 FILM PERMIT 18 SECTIONS: 19 5.38.010 Definitions. 20 5.36.020 Requirements. 21 5.38.030 Application --Filing and Fees. 22 5.38.040 Payment --Special City Services. 23 5.38.050 Permit --Rules and Regulations. 24 5.38.060 Permit—Modifications. 25 5.38.070 Permit --Exemptions. 26 5.38.080 Liability Provisions. 27 5.38.090 Permit --Failure to Obtain or Abide by its Terms 28 5.38.100 Constitutionality. 29 5.38.010 Definitions. 30 I For the purposes of this Chapter, the following words or phrases shall have the meanings as set out 31 1 herein. 32 A. "Charitable Films" shall mean Motion Pictures produced by a nonprofit organization, which 33 qualifies under Section 501(c)(3) of the Internal Revenue Code as a charitable organization. No person, directly 34 indirectly, shall receive a profit from the marketing and production of the film or from showing the film, tapes or 35 photos. 36 B. "Chief of Police" shall mean Chief of Police or his designee. 37 C. "City" shall mean any department or staff. 38 D. "City Manager" shall mean City Manager or his designee. 39 E. "Film Permit" is that permit required IA be obtained from the city prior to engaging in staging or 40 shooting Motion Pictures within the city boundaries. Item # 4
