1 ORDINANCE NO. o-22-99 <br />2 <br />3 AN ORDINANCE OF THE CITY OF COLTON AMENDING <br />CHAPTER 5.32 OF THE COLTON MUNICIPAL CODE <br />4 RELATING TO PUBLIC DANCES AND PUBLIC DANCE HALLS <br />5 THE CITY COUNCIL OF THE CITY OF COLTON DOES ORDAIN AS <br />FOLLOWS: <br />6 <br />SECTION 1: Chapter 5.32 of the Colton Municipal Code is hereby amended in its <br />7 <br />entirety to read as follows: <br />8 <br />9 "DANCES - DANCE HALLS <br />10 <br />Sections: <br />11 5.32.010 Definitions. <br />5.32.020 Permit--Required. <br />12 5.32.030 Permit--Application. <br />5.32.040 Permit--Granting—Renewing. <br />13 5.32.050 Permit--Conditions. <br />5.32.060 Permit--Denial. <br />14 5.32.070 Permit--Suspension, Nonrenewal and Revocation. <br />5.32.080 Permit--Appeals. <br />15 5.32.090 Persons Employed as Dancing Partners--Unlawful. <br />5.32.100 Violation--Penalty—Permit <br />16 rendered void. <br />17 <br />5.32.010 Definitions. For purposes of this chapter certain words and phrases shall be <br />18 construed as set forth in this section. <br />19 A. "Dine and dance clubs" and "night clubs" shall mean all hotels, restaurants, <br />cafes, road houses, inns, taverns or any place open to the public, where bona fide meals are served, <br />2o and where the public may dance with or without charge. <br />21 B. "Nonprofit organization" means any lawfully organized nonprofit club, <br />society, association or other organization, organized or incorporated for benevolent, charitable, <br />22 dramatic or literary purposes, which has an established membership and holds meetings at regular <br />intervals for purposes other than to conduct a public dance. <br />23 <br />C. "Notice" shall mean written notice, given by personal service upon the <br />24 addressee, or given by United States mail, postage prepaid, addressed to the person to be notified at <br />his or her last known address. Service of such notice shall be effective upon the completion of <br />25 personal service, or upon the placing of the same in the custody of the United States Postal Service. <br />26 D. "Public dance" or "dance club" or "public dance hall" shall mean any place <br />where dancing is regularly conducted on certain days as a business, whether for profit or not for <br />27 profit, and to which the public is admitted, either with or without charge, or at which the public is <br />allowed to participate in the dancing, either with or without charge. <br />28 <br />E. "Permit" shall mean a written permit required and issued pursuant to the <br />RVPUB\MXM\521810 - 1 <br />Item #2 <br />
