Ztfm'dFa--C6ff rh'6nn- y'Development Director <br />SUBJECT: Recommendation to reject for cause construction bids for the Colton <br />Museum Restoration Project opened on March 14, 2000, and Request for <br />Authorization to solicit new bids for the Community Development Block <br />Grant (CDBG) Project #104-22212 - Colton Museum Restoration <br />DATE:_ March 27, 2000 <br />BACKGROUND: <br />This project consists of the restoration of the exterior of the Colton Museum; the project is <br />funded by Community Development Block Grant (CDBG) funds. <br />The bid opening for the CDBG Project #104-22212 - Colton Museum Restoration was held on <br />March 14, 2000. There were three (3) bid proposals submitted: <br />• Southland Empire: $149,871 <br />• Wyatt Construction: $185,108 <br />• W.B. Allen Construction: $283,199 <br />DISCUSSION/ANALYSIS: <br />Upon review of the bid proposals by City staff, several instances of non-compliance were <br />noted for each of the submittals. A meeting between City staff and City Attorney Dean Derleth <br />was held; the course of action suggested by the Attorney was to: <br />• Reject all three (3) bids on the basis of non-compliance with the contract documents and <br />specifications. <br />• Prepare a new set of contract documents and specifications, incorporating all Addenda <br />items and further clarifying/stressing those items with which the bidders seem to have the <br />most problems. <br />• Return to the City Council with a request to rebid the project. <br />The San Bernardino County Department of Economic and Community Development (ECD) <br />was contacted and is in full agreement with this request, providing the rebidding process <br />follows the same guidelines as the original bidding process with regard to their time frames <br />(minimum 30 -day bid) and required forms. <br />FINANCIAL IMPACT: <br />No impact to the City General Fund. The project will be funded with CDBG funds. Currently, <br />$115,755 is available in the project account. Under separate action, the City Council will be <br />Item #6 <br />
