CITY OF COLTON Item #11
AGENDA REPORT
FOR THE COUNCIL MEETING OF October 16.2001
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
4
FROM: Ronald C. Kenny, Director of Parks, Recreation and Family Services et
SUBJECT: Approval of Joint Use Agreement between the City of Colton and the Colton
Unified School District for Colton Middle School
DATE: October 4, 2001
The City of Colton and the Colton Unified School District have always enjoyed a supportive relationship.
Joint Use Agreements between the two agencies have been developed over the years for joint use of City
and School District facilities. These Agreements have been developed on a facility by facility basis.
ANALYSIS/DISCUSSION:
The City, School District and Colton Youth Soccer Organization are partnering in an effort to obtain a
State of California grant for sport lighting at Colton Middle School. The school has been the home of the
soccer organization for 24 years. During that time the group has not had the benefit of lights for weekday
practice sessions. They have requested that the City apply for one of many grants available under the
Safe neighborhood Parks, Clean Water, Clean Air and Coastal Protection Bond Act of 2000. By State
grant requirements, only a government entity may apply. The group has also requested the School
District's permission to place the lights at Colton Middle School. The Soccer Organization will be
responsible for the bulk of the work required to complete the grant.
One of many requirements of the grant is a Joint Use Agreement between the City and the School District
for Colton Middle School. The proposed Agreement developed by the District is attached. Important
components of that Agreement include:
• Use of Colton Middle School playfields shall be subject to reasonable rules and regulations as
determined by the District.
• Each party to this Agreement holds the other harmless from all claims or lawsuits.
• District will be responsible for the upkeep of the fields.
• Agreement is null and void should the City be unsuccessful in its application for the grant.
• The Agreement remains in force for a period of not less than 20 years. However, it can be
terminated by either party at the end of any traditional school year with 60 days prior notice.
ENVIRONMENTAL IMPACT:
None.
FISCAL IMPACT:
Unknown at this time.
