FRASER, DIRECTOR OF WATER & WASTEWATER OPERATIONS SUBJECT: SET A PUBLIC HEARING FOR JULY 16, 2002 TO ADOPT A RESOLUTION AMENDING THE BASIC FEE FOR STORMWATER MANAGEMENT AND THE STORMWATER MANAGEMENT FEE DATE: June 24, 2002 BACKGROUND In October 1990 the County of San Bernardino Flood Control District was issued a five-year NPDES Stormwater Permit, with 16 incorporated cities as co -permittees. The second five-year permit took effect for the period of October, 1995 to October, 2000, and a third permit is now in effect until October 2005. DISCUSSION /ANALYSIS There is no increase in the Basic Fee for Stormwater Management and the Stormwater Management Fee. Landowners, who have not changed their property usage, will not receive an increase over previous four years' fees. The proposed amendment affects only the vacant parcels that have been developed, or have changed to a different designated land use group. The fees collected this year will fund FY03-04, which includes the City's operational costs for street sweeping, storm drain cleaning, roadway maintenance and litter control. FISCAL IMPACT The cost to the City's residential and commercial landowners is the same as previous years. The revenue is used to fund the City's NPDES Stormwater Program, as mandated by Federal and State regulations. Without the Stormwater Fees, the General Fund would have to cover the costs for the on-going Stormwater Program (FY02-03 $640,570). ENVIRONMENTAL IMPACT The NPDES Stormwater Program is a part of the Federal Clean Water Act and is intended to improve the Nation's waterways. Compliance with the NPDES Stormwater requirements is mandated by the Federal Government and the State Regional Water Quality Control Board enforces the requirements. RECOMMENDATION Staff recommends that the Colton Utility Authority set a Public Hearing for July 16, 2002 to adopt a Resolution Amending the Basic Fee for Stormwater Management and the Stormwater Management Fee as set by the Colton Municipal Code, Chapter 14.01.
