Item #18 <br />CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF June 18, 2002 <br />Honorable Mayor and City <br />FROM: City Attorney <br />SUBJECT: Resolution Overturning Planning Commission Decision to Deny <br />Application by Jack-in-the-Box, Inc. for Design Review, Environmental <br />Assessment, Major Variance and Conditional Use Permit (File Index <br />Number DCV -93-01) For Construction of a Fast Food Drive -Through <br />Restaurant <br />DATE: <br />BACKGROUND: <br />June 18, 2002 <br />At the City Council meeting on June 4, 2002, the Council voted to overturn the Planning <br />Commission's denial of File Index Number DVC -93-01, an application by Jack-in-the-Box, <br />Inc. requesting Design Review, Environmental Assessment, Major Variance and <br />Conditional Use Permit for the construction of a 2,561 square foot fast food drive-through <br />restaurant, and directed staff to prepare the resolution to effectuate its decision. <br />DISCUSSION/ANALYSIS: <br />In addition to the City Council's direction to overturn the Planning Commission's denial of <br />the Jack-in-the-Box application, Council directed City staff to incorporate three additional <br />conditions of approval into the project. The three additional conditions of approval include: <br />(1) entering into an agreement with the adjacent Yum Yum restaurant for 10-11 additional <br />parking spaces; (2) directing lighting to the back area of the parking lot and the vacant <br />back lot of the property; and (3) installing a chain link fence around the back area of the <br />property. All three of these conditions have been incorporated into the conditions of <br />approval for the project. The revised conditions of approval are included with the proposed <br />resolution as Exhibit "A." <br />ALTERNATIVES: <br />Deny approval of Resolution. <br />2.
