CITY OF COLTON Item #8 <br />AGENDA REPORT <br />FOR CITY COUNCIL MEETING OF MARCH 26,2002 <br />TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS <br />FROM: RANDY HEUSTERBERG, POLICE C IIEF "j2 - <br />'M <br />ON TA <br />SUBJECT: ADOPT THE ATTACHED RESOLUTI 0 A ARDT RY TOWING <br />FRANCHISES TO SOUTH STATE TOWING AND EXCLUSIVE TOWING <br />DATE: MARCH 7,2002 <br />BACKGROUND <br />On September 1, 1998, the City Council adopted Ordinance No. 0-18-98, adding Chapter 10.40 to Title 10 of <br />the Colton Municipal Code concerning tow truck franchises for City Service. Section 10.40030 (a) of the <br />Colton Municipal Code states that all franchises granted to franchisees pursuant to this chapter shall be non- <br />exclusive and shall be for a term of no longer than six (6) years as specified by the City Council in the <br />resolution or ordinance granting the franchise. <br />On January 19, 1999, the City Council adopted Resolution No. R-1 1-99 awarding towing franchises to South <br />State Towing and Exclusive Towing for a three (3) year period. Both of these franchises expired on February <br />28, 2002. Section 10.40.030 (b) of the Colton Municipal Code allows the City to have four (4) towing <br />franchises. The City currently has only two (2) active towing franchises. <br />DISCUSSION/ ANALYSIS <br />The Chief of Police has authorized the Purchasing Division to solicit Request for Qualifications to fill the two <br />vacant towing franchises. This process will take approximately three (3) months. The City Council may adopt <br />a resolution to award temporary towing franchises for this interim period. The authority for this is granted in <br />Section 10.40.030 (d) of the Colton Municipal Code which states that in granting any tow truck operator <br />franchise, the City Council may prescribe such other terms and conditions, not in conflict with this chapter, as <br />determined by the City Council to be in the best interest of the City and the public. <br />Staff is requesting the City Council adopt the attached resolution awarding temporary towing franchises to <br />South State Towing and Exclusive Towing for the period April 1, 2002 through June 30, 2002, which will allow <br />Purchasing time to complete the Request for Qualifications process and make a recommendation to fill the two <br />vacant positions. <br />FINANCIAL IMPACT <br />Loss of Franchise Fees for the period of time that the two towing franchise positions are vacant <br />ENVIRONMENTAL IMPACT <br />None <br />RECOMMENDATION <br />Staff recommends the City Council adopt the attached resolution and accompanying agreements to award <br />temporary towing franchises to South State Towing and Exclusive Towing for the period April 1, 2002 through <br />June 30, 2002. <br />J.
