CITY OF COLTON Item #22 <br />AGENDA REPORT <br />For the Colton Utility Authority Meeting of August 5, 2003 <br />TO: HONORABLE CHAIRPERSON AND MEMBERS OF THE COLTON UTILITY AUTHORITY <br />FROM: ERIC FRASER, DIRECTOR OF WATER AND WASTEWATER OPERATIONS <br />SUBJECT: ADOPTION OF THE ATTACHED RESOLUTION TO DECLARE THAT AN EMERGENCY <br />CONDITION EXISTED IN THE COLTON AVENUE SEWER MAIN AND RATIFICATION OF <br />THE CITY MANAGER'S ACTIONS TO EXECUTE IMMEDIATE REPAIRS <br />DATE: July 29, 2003 <br />On June 26, 2003, staff responded to a reported sewage overflow on 10`h Street between 'E' and 'F' Streets. <br />Staff determined that spill was a result of the sewer main collapsing. Staff immediately contained the spill and <br />initiated emergency bypass operations. City staff initiated excavation to determine the extent of damage to the <br />sewer, but was impeded by an old street that was buried approximately four feet below the existing street <br />grade. A pipeline contractor was hired to complete the repairs to the sewer line. <br />Section 22050 of the Public Contract Code allows the Colton Utility Authority to pass a resolution by a four- <br />fifths vote of its membership declaring that an emergency condition exists and delegating authority to order <br />actions required by that emergency without giving notice for bids to let contracts. <br />DISCUSSION/ANALYSIS <br />Due to the health and safety issues associated with a failed sewer line and associated spill; immediate action <br />was necessary to restore the sewer to operable condition. Staff monitored the bypass operation throughout <br />the night until the sewer was placed back into service. <br />FINANCIAL IMPACT <br />Funds are available in the Wastewater Unscheduled Immediate Line Repairs Account Number 522-8200- <br />8200-2303-0000-000. <br />ENVIRONMENTAL IMPACT <br />The spill was fully contained and managed in accordance with state and local regulations. The sewer was <br />returned to operable condition within 24 hours. <br />CONFLICT OF INTEREST — Gift Disclosure Requirements <br />Norstar Plumbing & Engineering Company <br />President: Gary Plummer <br />Contact: Same <br />RECOMMENDATION: <br />Staff recommends that the Colton Utility Authority adopt the attached Resolution declaring an emergency <br />condition exists within the city that requires immediate action to safeguard public health; and, ratify the actions <br />of the City Manager, pursuant to Section 22050 of the Public Contract Code, who executed a contract with <br />Norstar Plumbing and Engineering for emergency repairs and services in an amount not to exceed $9,960. <br />Prepared by: Eric R.
