Item #3 <br />CITY OF COLTON <br />AGENDA REPORT <br />FOR THE CITY COUNCIL MEETING OF FEBRUARY 18,2003 <br />TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS <br />FROM: AMER JAKHEF, P.E., CITY ENGINEER & <br />SUBJECT: APPROVAL OF DISADVANTAGED BUSINESS ENTERPRISE (DBE) <br />PROGRAM FOR OCTOBER 1, 2002 TO SEPTEMBER 30, 2003, <br />RESOLUTION AND NOTICE TO PUBLIC <br />DATE: FEBRUARY 6,2003 <br />BACKGROUND: <br />In 1984, City Council first adopted the Disadvantaged Business Enterprise (DBE) Program as <br />required by Federal Regulations. The program defines disadvantago� businesses and goals for a <br />percentage of public works contracts to be awarded each year. The California Department of <br />Transportation (CalTrans) has been entrusted with local agency oversight responsibility for DBE <br />implementation since 1999, and as such, has the responsibility of overseeing Colton's DBE <br />Program. <br />New Federal Regulations (49 CFR Part 26) governing the DBE Program became effective March 4, <br />1999. Part 26 replaced Part 23, Title 49 of the California Federal Regulations (CFR), as the final <br />rule binding on all recipients of Department of Transportation (DOT) funded or assisted contracts. <br />In July 2000, CalTrans received approval from the Federal Highway Administration (FHWA) of <br />the local assistance procedures needed to implement the new regulations. Previous DBE <br />requirements (49CFR23) are now superseded by the new regulations (49CFR26). <br />Colton has several Federally funded or assisted CIP projects scheduled for 2002-2003, such as <br />Community Development Block Grant (CDBG) projects, Air Quality Congestion Mitigation and <br />Air Quality (CMAQ) Improvement Program projects. In order for the City to continue to receive <br />Federal funding for said projects, the Goals for the City's DBE Program must be reviewed and <br />revised each Federal Fiscal Year (FFY). <br />ANALYSIS/DISCUSSION: <br />The City of Colton routinely solicits public bids for CIP Projects throughout the year; a good <br />percentage of these projects are federally farded, such as the Community Development Block <br />Grant (CDBG) Projects. The City expects to solicit public bids for five (5) CDBG projects <br />throughout federal fiscal year (FFY) 2002-2003. <br />
