Item #13 CITY OF COLTON AGENDA REPORT FOR CITY COUNCIL MEETING OF MARCH 18, 2003 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: THOMAS K. CLARKE, ELECTRIC UTILITY DIRECTOR SUBJECT: REQUEST TO ACCEPT PERMANENT EASEMENT FROM THE CITY OF SAN BERNARDINO FOR CONSTRUCTION, OPERATION, AND MAINTENANCE OF AN ELECTRIC POWER TRANSMISSION LINE DATE: March 10, 2003 BACKGROUND: The Engineering, Procurement, and Construction (EPC) agreement for the Agua Mansa Power Plant was approved by Council on May 21, 2002. Acquisition of right of way dedications for a transmission line corridor for the power plant is required across several parcels of property adjacent to and near the Beckett property. DISCUSSION/ ANALYSIS: The necessary grant of easement for the parcel jointly owned by the City of San Bernardino and the City of Colton was prepared by counsel for the City of San Bernardino, and was reviewed by Best, Best, and Krieger. The property description was prepared by KCT Consultants, Inc., a civil engineering firm retained by EI Colton, the developer of the Agua Mansa Power Plant. The grant of easement was submitted to and approved by the council for the City of San Bernardino on March 3, 2003. The proposed grant of easement as signed by officials of the City of San Bernardino and a legal description of the property is attached as Exhibit "A" and "1". FINANCIAL IMPACT: This grant of easement by the City of San Bernardino is given at no cost to the City of Colton. ENVIRONMENTAL IMPACT: All items relating to the Environmental Impact Report and the requirements of CEQA have been satisfied for this project. RECOMMENDATION: Staff recommends that Council accept, on behalf of the City of Colton, the grant of easement by the City of San Bernardino as presented. Staff also recommends that the easement be duly submitted to the San Bernardino County Recorder's Office for official recordation.
