CLARKE, ELECTRIC UTILITY DIRECTOR <br />SUBJECT: REQUEST TO ACCEPT PERMANENT EASEMENT FROM THE CITY <br />OF SAN BERNARDINO FOR CONSTRUCTION, OPERATION, AND <br />MAINTENANCE OF AN ELECTRIC POWER TRANSMISSION LINE <br />DATE: March 10, 2003 <br />BACKGROUND: <br />The Engineering, Procurement, and Construction (EPC) agreement for the Agua Mansa Power Plant was approved <br />by Council on May 21, 2002. Acquisition of right of way dedications for a transmission line corridor for the power <br />plant is required across several parcels of property adjacent to and near the Beckett property. <br />DISCUSSION/ ANALYSIS: <br />The necessary grant of easement for the parcel jointly owned by the City of San Bernardino and the City of Colton <br />was prepared by counsel for the City of San Bernardino, and was reviewed by Best, Best, and Krieger. The property <br />description was prepared by KCT Consultants, Inc., a civil engineering firm retained by EI Colton, the developer of <br />the Agua Mansa Power Plant. The grant of easement was submitted to and approved by the council for the City of <br />San Bernardino on March 3, 2003. The proposed grant of easement as signed by officials of the City of San <br />Bernardino and a legal description of the property is attached as Exhibit "A" and "1". <br />FINANCIAL IMPACT: <br />This grant of easement by the City of San Bernardino is given at no cost to the City of Colton. <br />ENVIRONMENTAL IMPACT: <br />All items relating to the Environmental Impact Report and the requirements of CEQA have been satisfied for this <br />project. <br />RECOMMENDATION: <br />Staff recommends that Council accept, on behalf of the City of Colton, the grant of easement by the City of San <br />Bernardino as presented.
