CITY OF COLTON AGENDA REPORT For the Colton Utility Authority Meeting of June 1, 2004 Item #16 TO: HONORABLE CHAIRPERSON AND MEMBERS OF THE COLTON UTILITY AUTHORITY FROM: ERIC FRASER, DIRECTOR OF WATER AND WASTEWATER OPERATIONS SUBJECT: REQUEST TO ACCEPT PERMANENT EASEMENT FROM U.S. XPRESS ENTERPRISES, INC., FOR CONSTRUCTION, OPERATION, AND MAINTENANCE OF SEWER FACILITIES AND OTHER PUBLIC UTILITIES AND RELATED APPURTENANCES DATE: May 19, 2004 BACKGROUND One of the conditions put forth by US Xpress, Inc., for locating their facilities in the City was that we provide sewer service on Riverside Avenue. As an interim measure, US Xpress has been using on-site wastewater collection and storage facilities, and then hauling the waste to the City's Wastewater Treatment Plant by truck. DISCUSSION / ANALYSIS The City is designing wastewater facilities from Agua Mansa Road to Riverside Avenue, including a Gravity Sewer Line, Lift Station and Force Main. These facilities will accommodate businesses within the City of Colton, including AZ Bus Sales as well as future projects along Riverside Avenue. Through an agreement with the City of Rialto, the wastewater will be treated there. CONFLICT OF INTEREST - Disclosure Requirements Company: U.S. Xpress Enterprises, Inc. President: Patrick E. Quinn, President and Co -Chairman Contact: Same FINANCIAL IMPACT In their desire to obtain sewer service, US Xpress has deeded their property to the City at no cost. ENVIRONMENTAL IMPACT The initial study was completed by Chambers Group some time ago and a Negative Declaration has been adopted for the project. Staff recommends that the Colton Utility Authority accept, on behalf of the City of Colton, the Grant of Easement by US Xpress, Inc., as presented, which will allow the City to install wastewater facilities from Agua Mansa Road to Riverside Avenue. Staff further recommends that the easement be submitted to the San Bernardino County Recorder's Office for official recordation. Report Prepared by: Eric R.
