CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF OCTOBER 19, 2004 <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />FROM: DEAN DERLETH <br />CITY ATTORNEY <br />Item #13 <br />SUBJECT: LETTER OF AUTHORIZATION TO PERMIT BIOSOILS INC. TO <br />SUBMIT LAND USE APPLICATIONS AND ENVIRONMENTAL <br />DOCUMENTS TO CONSTRUCT A BIOSOLIDS DRYER FACILITY TO <br />PROCESS MUNICIPAL WASTEWATER SOLIDS ON A PORTION OF <br />CITY PROPERTY LOCATED AT 1201 S. RANCHO AVENUE <br />(COLTON WATER RECLAMATION FACILITY) <br />DATE: October 11, 2004 <br />BACKGROUND/ DISCUSSION/ANALYSIS: <br />In closed session at the September 21, 2004 City Council meeting, staff was directed to <br />pursue discussions with BioSoils Inc. (Jim Sullivan) regarding their unsolicited proposal to <br />develop terms for an agreement to construct and operate a biosolids dryer facility to <br />process municipal wastewater solids on a portion of City property located at 1201 S. <br />Rancho Avenue (the Colton Wastewater Facility). BioSoils has requested an Agreement <br />that would generally provide that the City would lease a portion of the Wastewater <br />property to BioSoils for a minimum term of 20 years. In return, BioSoils would design, <br />construct and operate a regional biosolids dryer and sludge dewatering system on the <br />property for further processing of wastewater solids from the City and other publicly <br />owned treatment works. Shared revenue from the facility would provide funds for the long <br />term upgrades and improvements for the Public Utilities, Water and Wastewater <br />Department. <br />Staff has begun discussions with BioSoils regarding a potential agreement. A first step in <br />the process, however, is for BioSoils to submit land use and environmental applications to <br />the Community Development Department for review and consideration by the Planning <br />Commission. Since the City is the property owner of the Wastewater property and City <br />application requirements require applicants to submit letters of authorization from property <br />owners, BioSoils has requested a Letter of Authorization from the City. <br />The letter would be for the sole purpose of authorizing BioSoils to submit land use and <br />environmental applications to the Community Development Department. <br />FINANCIAL IMPACT: <br />None.
