ITEM #16 CITY OF COLTON AGENDA REPORT FOR THE COUNCIL MEETING OF AUGUST 16, 2005 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: Joe Figueroa, Risk Management Technician APPROVAL: Anthony Arroyo, Human Resources Director SUBJECT: Request Determination of Disability Status for Fire Captain Daniel Servin DATE: August 3, 2005 BACKGROUND: On January 28, 1977, Daniel Servin was hired as a Firefighter Trainee for the Colton Fire Department. On June 4, 2005, Fire Captain Servin experienced chest pain while mowing the lawn outside Fire Station 212 as part of his assigned job duties. On June 13, 2005, Mr. Servin received treatment at St. Bernardine's Medical Center and was diagnosed with a blockage to his main artery. ANALYSIS/DISCUSSION: Fire Captain Daniel Servin conveyed his decision to pursue industrial disability retirement with CalPERS on June 16, 2005. By law, the City Council is required to make a determination of the member's disability. As a result of the industrial disability retirement, Mr. Servin's retirement date will be August 16, 2005 --the date of the City Council approval. Since the application is for industrial disability retirement, the City Council can proceed to act on the issue of disability retirement by issuing a formal finding stating that Mr. Servin was disabled by an injury, as determined competent by medical opinion, which rendered him incapable of adequately performing the duties of a Fire Captain, a position in the Colton Fire Department. ENVIRONMENTAL IMPACT: This item carries no environmental impact. FISCAL IMPACT: There is no financial impact to the present budget since CalPERS will determine disability pension payments. RECOMMENDATION: It is respectfully recommended that the Members of the City Council approve and adopt the proposed Resolution, determining the disability retirement status of Fire Captain Daniel Servin.
