Zamora, Community Development Director <br />SUBJECT: Appeal of the Colton Planning Commission's Denial of File Index <br />Number DAP -000-284 - An Amendment to the General Plan Land Use <br />Map to Re -designate Property from Open Space to Light Industrial; An <br />Amendment to the City of Colton Official Zoning Map to Rezone Property <br />from OS (Open Space) to M-1 (Light Industrial); A Conditional Use <br />Permit, Architectural/Site Plan Review and Environmental Assessment to <br />Establish and Operate a Lumber Milling Operation on a 10.5 acre Parcel <br />Located South of Congress Street, East of the Union Pacific Railroad <br />(APN 0163-362-26-0000). (Appeal by David Avina and Isela Gonzalez <br />dba Pico Rivera Pallet, Inc.) <br />DATE: December 13, 2005 <br />BACKGROUND: <br />The applicant and appellant (David Avina and Isela Gonzalez dba Pico Rivera Pallet, Inc.) filed a <br />development applications requesting approval to establish and operate a lumber milling operation <br />on a 10.5 acre parcel of land located south of Congress Street and east of the Union Pacific <br />Railroad (APN 0163-362-26-0000) ("Subject Property"). The development applications included: <br />1. An amendment to the General Plan Land Use Map to re -designate the Subject <br />Property from Open Space to Light Industrial; <br />2. An amendment to the City of Colton Official Zoning Map to rezone the Subject <br />Property from OS (Open Space) to M-1 (Light Industrial); and <br />3. A Conditional Use Permit, Architectural/Site Plan Review and Environmental <br />Assessment to permit the establishment and operation of the lumber mill. <br />The Design Review Committee considered the development applications on May 3, May 17, and <br />recommended conditional approval on June 7, 2004. The development applications were <br />considered by the Planning Commission at several public hearings on September 19, September <br />27, October 11, and October 25, 2005. At the October 25" Planning Commission meeting, the <br />Commission, by a vote of 4 to 2, recommended denial of the General Plan Amendment and Zone <br />Change applications and denied the remaining development applications. The Applicant filed a <br />timely appeal of the Commission's denial of the development applications. <br />ANALYSIS/DISCUSSION: <br />The Appellants are the owners of the existing Pico Rivera Pallet Company located at 240 East <br />Congress Street. Pallets are wood platforms that are used to stack goods and products which are <br />transported to their final destination. The pallet company mills lumber from tree logs and <br />assembles the cut lumber into pallets that are sold to commercial and industrial businesses. The <br />existing pallet company operates on a 7.6 -acre site. Their operations include the use of two open <br />ORANGEWW\22368.1 <br />
