Item #4 <br />CITY OF COLTON <br />AGENDA REPORT <br />FOR THE COUNCIL MEETING OF FEBRUARY 1, 2005 <br />TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL <br />FROM: Anthony Arroyo, Human Resources Manager <br />SUBJECT: Request Determination of Disability Status for Police Officer Teresa Michel <br />DATE: January 21, 2005 <br />BACKGROUND: <br />On November 4, 1993, Teresa Michel was hired as a Police Officer for the Colton Police Department. <br />On November 16, 2002, Officer Michel dislocated her finger while placing handcuffs on a suspect who <br />then spun away. Officer Michel held onto the handcuffs as her finger and hand were twisted. On <br />October 5, 1004, Officer Michel was determined to be a qualified injured worker. <br />ANALYSIS/DISCUSS ION: <br />Officer Teresa Michel filed for industrial disability retirement with PERS on November 30, 2004. By law, <br />the City Council is required to make a determination of the members disability. As a result of the <br />industrial disability retirement, Ms. Michel's retirement date will be February 2, 2005—the date of the <br />City Council approval. <br />Even though the application is for industrial disability retirement, the City Council can proceed to act on <br />the issue of disability retirement by issuing a formal finding stating that Officer Michel was disabled by <br />an injury, as determined by a competent medical opinion, which rendered her incapable of substantially <br />performing the duties of a Police Officer, a position in the Colton Police Department. <br />ENVIRONMENTAL IMPACT: <br />This item does not carry environmental impact. <br />FISCAL IMPACT: <br />There is no fiscal impact to the present budget since CalPERS will determine disability pension <br />payments. The city may have to forward Officer Michel the PERS industrial disability retirement monies <br />since PERS is reviewing all industrial disability claims; the time period for Officer Michel to receive her <br />retirement benefits may exceed 60 days. The city is credited (i.e., refunded) by PERS for any monies <br />that were paid to Officer Michel. <br />RECOMMENDATION: <br />It is respectfully recommended that the Members of the City Council approve and adopt the proposed <br />Resolution, determining the disability retirement status of Police Officer Michel. <br />ATT: Resolution <br />City Attorney: b- Finance Director: <br />City Manager: OTHER: <br />Agenda Report for T Michel IDR 011505 <br />
