Item #3 <br />CITY OF COLTON <br />AGENDA REPORT <br />FOR THE COUNCIL MEETING OF MAY 3, 2005 <br />TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCII, <br />FROM: DARYL PARRISH, CITY MANAGER <br />SUBJECT: APPROVAL OF CABLE TELEVISION FRANCHISE AGREEMENT <br />WITH ADELPHIA CABLE <br />DATE: APRIL 25, 2005 <br />BACKGROUND/ANALYSIS: <br />At its meeting on April 5`�, the City Council considered adoption of an ordinance approving a cable <br />franchise ageement with Adelphia Cable, which is currently providing cable service within Colton <br />under the provisions of an expired cable franchise agreement. <br />The City Council requested that the franchise agreement be amended to include an obligation for <br />Adelphia to repair private property damaged by Adelphia's activities. Adelphia has agreed to repair <br />irrigation equipment located in a public right-of-way that is damaged by Adelphia's activities, <br />provide the City with summaries of customer complaints upon request, and also to develop a <br />procedure for resolving customer complaints. <br />ALTERNATIVES: <br />Approve the revised cable television franchise agreement, or reject the agreement and direct staff to <br />engage in further negotiations with Adelphia. A rejection would continue the currently existing <br />situation, in which Adelphia is operating under an expired franchise agreement. <br />FISCAL IMPACT: <br />Positive fiscal impact through Adelphia's contriburion of up-front and ongoing financial support for <br />public access television. Franchise fees will remain unchanged. <br />ENVIRONMENTAL IMPACT: <br />None. <br />
