VERBATIM TRANSCRIPT <br />CITY COUNCIL MEETING <br />MARCH 15o 1994 <br />Actinq Poli -c -e Chief Ap)ointment <br />MAYOR: O.K., at this time, I'd like to ask Mrs. Biggs to <br />explain what the motion that wetre going to be <br />voting on. Mrs. Biggs! <br />CITY ATTORNEY** just to put this in the proper context. The <br />Acting Chief has resigned. There is no chief of <br />police appointed by this Council, at the present <br />time. There is a proposal that was set forth by <br />the City Manager to name Officer Cabral as acting <br />chief. It is appropriate for the City Manager <br />when there is a vacancy to make those kinds of <br />proposals. There is a resolution adopted by the <br />City Council that establishes a ratification <br />procedure for recommendation by the City Manager <br />for department heads. It's appropriate for the <br />City Council to ratify the recommendation or not <br />to ratify the recommendation of the city Manager. <br />The report 'that"s before the Council also contains <br />recommended appointments. Those are really <br />informational items for the Council. They are not <br />part of what the Council has decided it has the <br />authority to review or to recommend. Those are <br />'matters for the City Manager and the Acting Police <br />Chief, whoever he may be, to determine after the <br />acting police chief is named. <br />This is an Interim position. It is not a <br />permanent position. It needs to be filled and <br />thatts the question --the issue before the Council <br />tonight. <br />CM BENNETT Julie, isn't it appropriate if the Council chooses <br />also, though, to put this aside temporarily and <br />look Into the reasons behind the resignation of <br />the Chief? <br />CITYATTORNEY The Council has that authority. There,'s no <br />mandate that you make a decision. <br />MAYOR I would like to, at this time, make a motion that <br />we adopt staff recommendation on the rati.fication <br />of the Acting Police Chief Cabral.
