VERBATIM TRANSCRIPT
CITY COUNCIL MEETING
MARCH 15o 1994
Actinq Poli -c -e Chief Ap)ointment
MAYOR: O.K., at this time, I'd like to ask Mrs. Biggs to
explain what the motion that wetre going to be
voting on. Mrs. Biggs!
CITY ATTORNEY** just to put this in the proper context. The
Acting Chief has resigned. There is no chief of
police appointed by this Council, at the present
time. There is a proposal that was set forth by
the City Manager to name Officer Cabral as acting
chief. It is appropriate for the City Manager
when there is a vacancy to make those kinds of
proposals. There is a resolution adopted by the
City Council that establishes a ratification
procedure for recommendation by the City Manager
for department heads. It's appropriate for the
City Council to ratify the recommendation or not
to ratify the recommendation of the city Manager.
The report 'that"s before the Council also contains
recommended appointments. Those are really
informational items for the Council. They are not
part of what the Council has decided it has the
authority to review or to recommend. Those are
'matters for the City Manager and the Acting Police
Chief, whoever he may be, to determine after the
acting police chief is named.
This is an Interim position. It is not a
permanent position. It needs to be filled and
thatts the question --the issue before the Council
tonight.
CM BENNETT Julie, isn't it appropriate if the Council chooses
also, though, to put this aside temporarily and
look Into the reasons behind the resignation of
the Chief?
CITYATTORNEY The Council has that authority. There,'s no
mandate that you make a decision.
MAYOR I would like to, at this time, make a motion that
we adopt staff recommendation on the rati.fication
of the Acting Police Chief Cabral. Is there a
second:.
