UrgencyFndings. The City Council finds that this Urgency Ordinance <br />is necessary to promote the immediate preservation of the public peace, health and safety. In <br />recent weeks, West Nile virus has likely emerged in the City of Colton and surrounding areas, <br />presenting a threat to public, equine, and animal health. The most serious manifestation of West <br />Nile virus infection is fatal encephalitis (inflammation of the brain) in humans and horses, as well <br />as mortality in certain domestic and wild birds. The City Council wishes to adopt changes to its <br />dead animal body removal disposal provisions to assure that the public has a safe and <br />convenient method of disposing of small birds that have been infected with West Nile virus. <br />Section 2. Section 6.16.270 of the Colton Municipal Code is hereby amended <br />to read as follows: <br />"6.16.270 Dead animal body removal. <br />A. No person shall place the body of any dead animal in any refuse <br />receptacle. The bodies of any dead animals shall be promptly removed as directed by the <br />sanitarian, and the owner thereof shall pay the costs to the city for removal of such animal. <br />B. Notwithstanding the prohibitions contained in subsection A, birds not <br />exceeds three (3) pounds in weight may be placed in refuse receptacles for disposal provided <br />they are first placed in a plastic bag or container with the openings secured. This subsection <br />shall be effective for twelve months from the date of its adoption. Thereafter it shall be of no <br />further force or effect." <br />Section 3. Effective Date. This Urgency Ordinance was adopted by the <br />necessary four-fifths vote of the members of the City Council pursuant to California Government <br />Code Section 36934 and 36937, and shall take effect immediately upon its adoption. <br />
