1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />117 <br />18 <br />19 <br />20 <br />21 <br />22 <br />.23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />29 <br />30 <br />31 <br />32 <br />RESOLUTION NO. 3602 <br />WHEREAS, under the provisions of Title II - Section 8 of the Housing and <br />Community Development Act of 1974, the United States of America, acting through <br />the Secretary of the Department of Housing and Urban Development is authorized <br />to enter into Annual Contributions Contracts to provide financial assistance to <br />public housing agencies; and <br />WHEREAS, pursuant to an Annual Contributions Contract with the Department <br />of Housing and Urban Development, public housing agencies may enter into con- <br />tracts to make housing assistance payments to owners of existing dwelling units <br />on behalf of eligible families; and <br />WHEREAS, the Housing Authority of the County of San Bernardino has been <br />duly authorized to exercise its powers under the Housing Authorities Law of the <br />State of California and desires to operate within the City of Colton; and <br />a local housing authority or public housing agency has not been <br />authorized to transact business in the City of Colton; and Section 34209 of the <br />California Health and Safety Code prohibits County housing authorities from <br />operating within any city located in the County for which a local Authority has <br />not been authorized to transact business unless the consent of the governing <br />body of such city shall have been obtained; and <br />WHEREAS, through the Housing Assistance Plan submitted to the Department of <br />Housing and Urban Development, the City of Colton; has agreed to a goal with re- <br />gard to participation in the Section 8 - existing Housing Program; and <br />'WHEREAS, the Housing Authority of the County of San Bernardino will adminis- <br />ter the allocation of units in accordance with the established Housing Distribu- <br />-tion Plan, as approved; <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Colton <br />does hereby resolve as follows: <br />ll <br />1. Pursuant to Section 34209 of the California Health and Safety Code <br />consent is hereby given to the Housing Authority of the County of <br />San Bernardino to operate within the City of Colton. <br />2.
