a T - RESOLUTION NO. 3671 CITY OF COLTON RESOLUTION OF THE CITY COUNCIL ORDERING CERTAIN CHANGES AND MODIFICATIONS IN PROCEEDINGS AND ASSESSMENTS IN ASSESSMENT DISTRICT, PURSUANT TO "MUNICIPAL IMPROVE- MENT ACT OF 1913.," (DIVISION 12 OF THE STREETS AND HIGHWAYS CODE OF THE STATE -OF CALIFORNIA ASSESSMENT DISTRICT NO. 1976-1 (COOLEY DRIVE) WHEREAS, this City Council dial, on the 18th day of JANUARY, 1`977 , adopt its Resolution of Intention pursuant to the provisions of the "Municipal Improvement Act of 1913,". being Division 12 of the Streets and Highways Code of the State of Cali- fornia, for the construction of certain public works of improvements, together with appurtenances and appurtenant work in connection there- with in a special assessment district known and designated as ASSESSMENT DISTRICT NO. 1976-1 (COOLEY DRIVE); and, WHEREAS, subsequent thereto, this City Council did, by Resolution, approve the "Report" and call for sealed bids on the construction"of the works -of improvement as contemplated in said assessment district; and WHEREAS, prior to said public hearing, sealed bids were received and considered for the construction of the works of improve- ment in the assessment district, and based on the recommendations therefor, it is now determined that assessments can be amended and modified because of the favorable construction bid so received; and WHEREAS, it now appears to this City Council that certain changes and modifications should be considered in the "Report" and assessments for the above -referenced assessment district, NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLTON, AS FOLLOWS: SECTION.I. The above recitals are all true and correct. SECTION 2. That it is in the best public interest and convenience that assessments be modified, amended and reduced as set forth on Exhibit "A" attached hereto and made a part hereof, and said City Council does hereby order the proceedings, the "Report"and the assessment roll to be modified and amended to reflect the amendments as set forth in said Exhibit "A" above -referenced, relating to ASSESSMENT DISTRICT NO. 1976-1 (COOLEY DRIVE). SECTION 3. That said changes and modifications above- mentioned are hereby ordered pursuant to the authority as set forth in Section 10352 of the Streets and Highways Code of the State of California (Municipal Improvement Act of 1913). SECTION 4. That theSuperintendentof Streets is hereby ordered to make the above -listed corrections and modifications for -the assessment roll, and the assessments as set forth in the "Report" previously approved. ,.Nm, �_ �_..
