RESOLUTION NO. 3751 RESOLUTION OF THE CITY COUNCIL MAKING FINDINGS ON WAIVER AND PETITION. CITY OF COLTON WHEREAS, certain property owners have presented to this City Coun- cil an executed Petition requesting the construction of certain public works of improvement, together with appurtenances, said im- provements to be constructed pursuant to tbeing of provisions of the "Municipal Improvement Act of 1913", 4 is the Streets and Highways Code of the State ofCalifornia, msdato be financed through bonds to be issued pursuant nd provisions of the "Improvement Act of 1911", being Division 7 of said Code, in a special assessment district known and designated as ASSESSMENT DISTRICT NO. 77-1 (COOLEY DRIVE, PHASE II) (hereinafter referred to as the "Assessment District"); and, WHEREAS, said Petition contains a waiver of the provisions and limitations of the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931", as provided for in Section 2804 of said Act; and, WHEREAS, it has been reported that said Petition and Waiver contains the signatures of owners representing more than sixty percent (60%) in area of the property to be subject to assessment for said pro- posed improvements. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLTON CALIFORNIA, AS FOLLOWS: SECTION 1. That the above recitals are all true and correct. SECTION 2. That the City Council finds that said Petition and Waiver has been signed by owners representing more than sixty percent (60%) in area of the property to be subject to assessment for the improvements re- quested in said Petition and meets the requirements of Section 2804 of Division 4 of the Streets and Highways Code of the State of California. SECTION 3. That said Petition and Waiver shall be filed in the Office of the City Clerk of said City.
