RESOLUTION NO. 3751 <br />RESOLUTION OF THE CITY COUNCIL MAKING <br />FINDINGS ON WAIVER AND PETITION. <br />CITY OF COLTON <br />WHEREAS, certain property owners have presented to this City Coun- <br />cil an executed Petition requesting the construction of certain <br />public works of improvement, together with appurtenances, said im- <br />provements to be constructed pursuant to tbeing of <br />provisions <br />of the "Municipal Improvement Act of 1913", 4 is <br />the Streets and Highways Code of the State ofCalifornia, msdato <br />be financed through bonds to be issued pursuant <br />nd <br />provisions of the "Improvement Act of 1911", being Division 7 of <br />said Code, in a special assessment district known and designated as <br />ASSESSMENT DISTRICT NO. 77-1 <br />(COOLEY DRIVE, PHASE II) <br />(hereinafter referred to as the "Assessment District"); and, <br />WHEREAS, said Petition contains a waiver of the provisions and <br />limitations of the "Special Assessment Investigation, Limitation <br />and Majority Protest Act of 1931", as provided for in Section 2804 <br />of said Act; and, <br />WHEREAS, it has been reported that said Petition and Waiver contains <br />the signatures of owners representing more than sixty percent (60%) <br />in area of the property to be subject to assessment for said pro- <br />posed improvements. <br />NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF COLTON <br />CALIFORNIA, AS FOLLOWS: <br />SECTION 1. That the above recitals are all true and correct. <br />SECTION 2. That the City Council finds that said Petition and <br />Waiver has been signed by owners representing more <br />than sixty percent (60%) in area of the property to <br />be subject to assessment for the improvements re- <br />quested in said Petition and meets the requirements <br />of Section 2804 of Division 4 of the Streets and <br />Highways Code of the State of California. <br />SECTION 3.
