R-130-04 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON DENYING THE APPEAL AND UPHOLDING THE <br />PLANNING COMMISSION'S RECOMMENDATION TO CERTIFY <br />THE FINAL ENVIRONMENTAL IMPACT REPORT PREPARED <br />FOR THE PACIFIC RAIL METAL SHREDDING OPERATION <br />PROJECT, ADOPT THE ADDENDUM TO THE FINAL <br />ENVIRONMENTAL IMPACT REPORT, ADOPT <br />ENVIRONMENTAL FINDINGS PURSUANT TO THE CALIFORNIA <br />ENVIRONMENTAL QUALITY ACT, ADOPT A MITIGATION <br />MONITORING PROGRAM, AND APPROVE THE PACIFIC RAIL <br />METAL SHREDDING OPERATION PROJECT: FILE INDEX NO. <br />D-55-01 <br />WHEREAS, the purpose of the Pacific Rail Shredder Operation Project ("Project") <br />is to provide a metal shredding facility to recycle regional metal supplies including automobile <br />bodies, rail cars and consumer appliances; and <br />WHEREAS, pursuant to section 21067 of the California Environmental Quality Act <br />("CEQA") (Pub. Resources Code, § 21000 et seq.), and section 15367 of the State CEQA <br />Guidelines (Cal. Code Regs., tit. 14, § 15000 et seq.), the CITY COUNCIL OF THE CITY OF <br />COLTON ("City") is the lead agency for the Project; and <br />WHEREAS, following preparation of an initial study for the Project, which <br />indicated that the Project might result in potentially significant adverse environmental impacts, <br />the City prepared an Environmental Impact Report ("EIR") and provided full disclosure of the <br />potential environmental effects of the Project as defined; and <br />WHEREAS, the Agency issued an initial Notice of Preparation for the Project on <br />November 1, 2002 and circulated it for a period of 30 days pursuant to State CEQA Guidelines <br />sections 15082, subdivision (a) and 15375, and prepared a revised Notice of Preparation for the <br />Project on May 19, 2003, and circulated it for a period of 30 days pursuant to State CEQA <br />Guidelines sections 15082, subdivision (a) and 15375, and; and <br />WHEREAS, the City held a scoping meeting on October 23, 2002, to solicit public <br />comments on the Project; and <br />WHEREAS, pursuant to State CEQA Guidelines section 15082, the City solicited <br />comments, including details about the scope and content of the environmental information as <br />well as potential feasible mitigation measures and alternatives, from responsible agencies, <br />trustee agencies, and the public; and <br />WHEREAS, the City narrowed the issues and alternatives for analysis in the Draft <br />EIR following receipt of written statements responding to the NOP; and <br />RVPUB�AI.B\683610.1 - 1 - <br />
