R-19-04 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON MAKING CERTAIN <br />FUNDINGS PURSUANT TO HEALTH AND SAFETY CODE SECTION 33445 AND <br />CONSENTING TO USING REDEVELOPMENT AGENCY FOR THE CITY OF COLTON <br />TAX INCREMENT FUNDS FOR THE INSTALLATION AND CONSTRUCTION OF PUBLIC <br />IMPROVEMENTS BENEFITTING THE SANTA ANA RIVER REDEVELOPMENT PROJECT <br />AREA. <br />WHEREAS, the Redevelopment Agency for the City of Colton (the "Agency") may, <br />with consent of the City Council of the City of Colton (the "City"), pay for all or a part of the <br />cost of the installation and construction of any building, facility, structure or other <br />improvement that is publicly owned either within or outside of the Santa Ana River <br />Redevelopment Project Area (the "Project Area") pursuant to Health and Safety Code <br />Section 33445; and <br />WHEREAS, the Agency obtained a loan of funds from the Colton Public Finance <br />Authority (the "Authority") pursuant to that certain loan agreement, entitled "Loan Agreement <br />(Santa Ana River Redevelopment Project), dated as of April 1, 1998 (the "1998 Santa Ana <br />River Loan Agreement"), authorizing the Agency to draw certain funds from the "Santa Ana <br />River Bond Account" in an aggregate amount not to exceed $4,102,317.01, as a loan from <br />the Authority. The Agency may use and apply the proceeds of such loan funds for any of the <br />purposes authorized under Section 2.04 of the 1998 Santa Ana River Loan Agreement, <br />including for paying the cost of the installation and construction of buildings, facilities, <br />structures or other improvements that are publicly owned and situated within or of benefit to <br />the Santa Ana River Redevelopment Project Area; and <br />WHEREAS, the Agency requested that the citizen advisory committee for the Santa <br />Ana River Project Area (the "CAC") provide its recommendation to the Agency for the <br />prioritization of certain public improvement projects for the benefit of the Santa Ana River <br />Redevelopment Project; and <br />WHEREAS, on December 7, 1999, the Agency prioritized the public improvement <br />projects for the benefit of the Santa Ana River Redevelopment Project Area; and <br />
