R-35-04 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, <br />CALIFORNIA, APPROVING A RANCHO MILL PUBLIC WORKS PROJECTS <br />FUNDING AND CONSTRUCTION MANAGEMENT AGREEMENT BY AND <br />BETWEEN THE CITY OF COLTON AND THE REDEVELOPMENT AGENCY FOR <br />THE CITY OF COLTON AND DIRECTING THE CITY ENGINEER TO PROCEED <br />WITH THE COMPLETION OF THE RANCHO MILL PROJECTS AS PROVIDED IN <br />SUCH AGREEMENT <br />WHEREAS, the Redevelopment Agency for the City of Colton has adopted its <br />resolution of even date herewith entitled: <br />"A RESOLUTION OF THE REDEVELOPMENT AGENCY <br />FOR THE CITY OF COLTON APPROVING A RANCHO MILL <br />PUBLIC WORKS PROJECTS FUNDING AND <br />CONSTRUCTION MANAGEMENT AGREEMENT BY AND <br />BETWEEN THE CITY OF COLTON AND THE AGENCY"; and <br />WHEREAS, the City of Colton, (the "City") desires to undertake the <br />completion of the acquisition, design, construction and improvement of each of the "Rancho <br />Mill Projects" as identified in the Rancho Mill Public Works Construction Management <br />Agreement (the "Construction Management Agreement") as submitted at the meeting at <br />which this Resolution is approved; and <br />WHEREAS, the proposed public improvements are exempt pursuant to Section <br />15301 (c) of CEQA, thereby a Notice of Exemption will be filed with the office of County Clerk of <br />the Board of Supervisors. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON, <br />CALIFORNIA DOES RESOLVE AND ORDER AS FOLLOWS: <br />Section 1. The City Council hereby approves the Construction Management <br />Agreement attached hereto as Exhibit "A". The Mayor and the City Clerk are hereby <br />authorized and directed to execute the Construction Management Agreement on behalf of <br />the City, together with such technical and conforming changes to the text of the Construction <br />Management Agreement as may be recommended by the City Attorney so as to conform the <br />text to the specific public works construction and management responsibilities assumed by <br />the City under said Construction Management Agreement. <br />Section 2. The City Engineer is hereby authorized and directed to proceed with <br />the completion of the acquisition, design and construction of each of the Rancho Mill Projects <br />as set forth in the Construction Management Agreement and to submit final <br />recommendations to the City Council for the award of the appropriate public works contracts <br />
