I RESOLUTION NO. R-169-06 <br />2 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />3 COLTON ACCEPTING A TEMPORARY EASEMENT FROM <br />4 THE CITY OF SAN BERNARDINO FOR CONSTRUCTION <br />OF GROUNDWATER MONITORING WELL AND <br />5 APPURTENANT FACILITIES <br />6 WHEREAS, California Government Code section 27281 provides that a <br />7 governmental agency must accept an easement upon real estate by resolution; and <br />8 WHEREAS, the City of San Bernardino has approved a temporary easement <br />9 for the City of Colton to construct a groundwater monitoring well and appurtenant facilities <br />10 which will assist the City in its continuing efforts regarding perchlorate remediation; and <br />WHEREAS, the City Council of the City Colton desires to evidence its <br />I I acceptance of the temporary easement from the City of San Bernardino through the <br />12 adoption of this Resolution, as required by Government Code section 27281. <br />13 <br />BE IT NOW THEREFORE RESOLVED AS FOLLOWS: <br />14 <br />15 SECTION 1. The City Council hereby accepts the temporary easement <br />described in the grant of easement ("Easement") and Exhibits "A" and "B", which are <br />16 attached hereto and incorporated herein by this reference. <br />17 SECTION 2. The City Council authorizes the City Clerk to sign a Certificate <br />18 of Acceptance for the Easement on behalf of the City Council and directs staff to record <br />this Resolution with the San Bernardino County Recorder's Office. <br />19 SECTION 3. The City Clerk shall certify to the adoption of this Resolution. <br />20 <br />SECTION 4.
