CITY OF COLTON <br />AGENDA REPORT <br />For Council Meeting of70February 1_"o <br />TO: Honorable Mayor and City Council <br />FROM: Stephen Edwards, City Attorney <br />SUBJECT: Paradise Hills Moratorium/Bond Report. <br />Attachments: <br />Page 1 of. <br />Date: Feb. 131 1990 <br />At its meeting of February 6, 1990, the Council <br />directed the City Attorney to report as to a <br />moratorium or a bond with regard to "pick—up work" <br />repairs on the homes occupied by buyers in Tract <br />12198 "Phase One". This responds to that direction. <br />Tracts 12203 and 12204, "Phases Two and Three," are <br />not yet built and are legally separate from "Phase <br />One." <br />The need for repairs on houses in "Phase One" is <br />not a basis for a moratorium on building houses in <br />"Phases Two and Three." <br />There is no basis for the City to require a bond <br />for repairs on houses in "Phase One." <br />"Phases Two and Three," however, are subject to <br />various conditions and requirements. There are no <br />homes built there yet. Homes there may not be <br />built except after compliance with City conditions <br />and requirements. <br />The Director of Community Development has notified <br />Wayne Napthal of .the various items required by the <br />City prior to "Phases Two and Three" being eligible <br />for permits to build homes. <br />Please let me know if I may be of further service <br />in this matter. <br />ORIGINALltem No-2k— <br />CENTRAL <br />o dCENTRAL RECORDS <br />
