AGENDA REPORT <br />CITY OF COLTON <br />For City Coawil Meonj of <br />July 5, 1994 <br />May 31, 1994 <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />FROM: Julie Hayward Biggs, City Attorn� <br />SUBJECT: Revision of Purchasing Ordinance <br />BACKGROUND <br />Councilmember Beltran has requested that the City Council consider amendment <br />of the City's purchasing ordinance (Colton Municipal Code Chapter 3.08) regarding the <br />provisions of Section 3.08.150. That section authorizes the City Manager to award contracts <br />for professional services for approved budget items in amounts up to $100,000 without the <br />approval of the City Council. In addition, so long as funds are generally available in the budget, <br />the City Manager is authorized to award contracts for professional services in amounts up to <br />$50,000 without the approval of the City Council. Only those contracts for professional services <br />in excess of $100,000 are required to be approved by the City Council. <br />Section 3.08.150 sets forth the process for awarding such professional services <br />contracts, including a requirement that contracts in excess of $50,000 be awarded based upon <br />requests for proposal. The City Council has the authority to waive the request for proposal <br />requirement "if it finds that the public interest will not best be served by a formal proposal <br />process." The contract for construction of the Colton Community Center was approved by the <br />Council under that provision of the Municipal Code. <br />The City. Manager is authorized to award contracts for professional services <br />which are not anticipated to exceed $50,000 without a formal request for proposal process. <br />Contracts which are anticipated to exceed $10,000, however, must be based upon a written <br />proposal including the scope of service and a fee schedule. The City Manager is required to <br />provide the City Council on a quarterly basis a summary of all contracts which have been let <br />that exceed $10,000. <br />RECOMMENDATION <br />The Council should direct staff if it wishes to change the provisions of the <br />purchasing ordinance with regard to professional services contracts and the authorization it <br />wishes to grant to the City Manager to act without prior Council approval to award such <br />Item No. <br />
